There be and is hereby created a commission to be known as the
"Tax Increment Financing Commission" of the City of Peculiar, Missouri,
which Commission shall have continuous and perpetual existence unless
and until terminated by the Board of Aldermen of the City of Peculiar.

A. The
Tax Increment Financing Commission shall be composed of eleven (11)
members to be appointed as follows:
1. Two (2) members shall be appointed by the chief elected officer of
Cass County with consent of a majority of the Cass County Commission;
2. Two (2) members shall be appointed by the Board of Education of the
Raymore Peculiar School District;
3. One (1) member shall be appointed in any manner agreed upon by the
affected districts to represent all districts other than school districts
levying ad valorem taxes within the area selected for a redevelopment
project or the redevelopment area, excluding representatives of the
Peculiar Board of Aldermen.
4. Six (6) members shall be appointed by the Mayor of the City of Peculiar
with the consent of the majority of the Board of Aldermen.

A. The
terms of the members shall be:
1. At the option of the members appointed by the Mayor of the City of
Peculiar, the terms of the members of the Tax Increment Financing
Commission who are appointed by the school board or other taxing districts
shall coincide with the length of time a development project, redevelopment
plan designation of a redevelopment area as defined in the Act is
considered for approval by the Tax Increment Financing Commission.
Such term shall terminate upon final approval of the project, plan
or designation of the area by the City of Peculiar. Thereafter, the
Tax Increment Financing Commission shall consist of the six (6) members
appointed by the Mayor of the City of Peculiar, except that members
representing the school board and other taxing districts shall be
appointed as provided in the Act prior to any amendments to any redevelopment
plans, redevelopment projects or redevelopment area. If any school
district or other taxing jurisdiction fails to appoint members to
the Tax Increment Financing Commission within thirty (30) days of
receipt of written notice of a proposed redevelopment plan, development
area, the remaining members may proceed to exercise the power of the
Tax Increment Financing Commission.
2. Of the members first (1st) appointed by the Mayor of the City of
Peculiar, two (2) shall be designated to serve for a term of two (2)
years, two (2) shall be designated to serve for a term of three (3)
years and two (2) shall be designated to serve for a term of four
(4) years from the date of such initial appointments. Thereafter,
the members appointed by the Mayor of the City of Peculiar shall serve
for a term of four (4) years, except that all vacancies shall be filled
for unexpired terms in the same manner as were the original appointments.

Those Commission members who are appointed by school boards or other taxing districts pursuant to Section
127.030 above shall only be authorized to consider and vote on matters specifically and directly relating to a redevelopment area which is subject to ad valorem taxes levied by the taxing jurisdictions which appointed such members.

A. The
Tax Increment Financing Commission shall have the following duties
only:
1. To hold public hearings required by Section 99.825 of the Act on
any proposed redevelopment plan, redevelopment project or designation
of a redevelopment area or any amendment thereto and to provide notice
as required by Section 99.830 of the Act;
2. To vote on any such plan, project, designation or amendment within
thirty (30) days of the completion of any such hearing;
3. To make recommendations to the Board of Aldermen within ninety (90)
days of the completion of any such hearing; and
4. To undertake such other duties as may be expressly directed by the
Board of Alderman consistent with the Act, as from time to time amended.

The Tax Increment Financing Commission, upon the appointment
of members as required by this Chapter, at an initial meeting shall
organize itself and elect from its number a Chair, Vice Chair, Treasurer
and Secretary, each to serve for a one (1) year term or until a successor
is elected.

The Tax Increment Financing Commission shall adopt such rules
and regulations of operations as shall enable it to maintain an orderly
procedure for its business and effectively and efficiently exercise
the powers authorized by the Act and this Chapter. The Commission
shall call upon the attorney retained by the City for all legal options
and legal services and that the Commission shall call upon the City
Municipal Administrator and City staff for all technical planning
services which the Commission may require in the performance of its
duties under this Chapter.

All applications and amended applications filed with the City
seeking tax increment financing shall be accompanied by a fifteen
thousand dollar ($15,000.00) fee.
