No person shall make any excavation or opening in any street, alley, highway or other public way within the Village without first obtaining written permission from the department of public works.

The department of public works shall have control of all such openings and excavations, and shall decide if the Village shall make the excavations or openings requested.

Before written permission is granted, the applicant shall deposit with the Village Clerk a sum no less than $500 or equal to the amount determined by the department of public works in order to reimburse all costs related to the restoration of opening or excavation to the Village "Design Standards and Construction Specifications," and if the Village performs the excavation or opening, such additional amount as will reimburse all costs incurred.

All openings or excavations and surface restoration shall be completed in a reasonable amount of time as established by local, state, federal guidelines along with the determination of the department of public works and in compliance with the Village "Design Standards and Construction Specifications," or the Village shall restore referenced site, deducting such costs from deposit with any and all additional costs incurred.

Replacement material shall be in compliance with the Village "Design Standards and Construction Specifications."

Refund of deposit shall be returned only after final inspection approval by the department of public works and may be returned 30 days after final inspection.

Before written permission is granted, the applicant shall submit a certificate of insurance and evidence of workman's compensation insurance.

Any applicant who feels aggrieved by the provisions of this chapter may appeal to the Village Board at its next regular meeting. Such appeal may be the applicant does not wish the Village to make the opening or excavation when the board of public works decides the Village shall do so; that the deposit for costs determined too high; or any other pertinent matter. The Village Board may change the decisions appealed from.

This chapter shall not apply to public utilities, nor to independent contractors hired by public utility companies for public utility works.
