A. On November 4, 1997, the St. Ann voters approved the proposition to assess up to twenty-eight dollars ($28.00) per year as set out in Section
535.020 of this Chapter on all residential property containing six (6) or fewer dwelling units to provide funds to pay the cost of certain repairs of defective lateral sewer service lines serving such dwelling units. The City has made an investigation and has concluded that, for 1998, these funds will allow the City to pay up to sixty percent (60%) of the cost of such repairs. As the repair fund grows, the City will review its actual experience and, for future years, may adjust the percentage of payment.
B. A lateral sewer service line is a sewer
line which extends from the building foundation wall or exterior wall
to the sewer main in the street or sewer easement. It does not include
a sewer line located under any part of the building. A lateral sewer
service line may be located in a front, side or rear yard.
C. If an owner is experiencing a problem with
the lateral sewer service line, the owner should contact a plumbing
company or a drain and sewer cleaning company to have the line cabled.
The cost to cable the lateral sewer service line will not be a reimbursable
cost item. If the problem is not resolved by cabling of the line,
the property owner should contact the St. Ann Department of Public
Services, at City Hall, between the hours of 8:00 A.M. and 5:00 P.M.,
Monday through Friday. The owner must fill out an application and
bring a copy of the paid real estate tax bill for the property, a
receipt for cabling of the line not older than thirty (30) days, or
a letter from the Metropolitan Sewer. District stating that the lateral
sewer service line is defective, and an eight hundred dollar ($800.00)
application fee. No sewer lateral repair application shall be processed
for any applicant who, at the time of said application, is in violation
of any ordinance contained in Title IV, Land Use or Title V, Building
Code of the Municipal Code of the City of St. Ann.
D. The City will have the lateral sewer service
line video inspected.
E. If it is determined, through the video
inspection, that the lateral sewer service line is defective, the
City will solicit bids from its list of approved contractors, and
select the lowest and best bid to complete the required corrective
work. It is the responsibility of the applicant to arrange for the
corrective work to be completed with the chosen contractor. The City
will perform one (1) underground inspection and one (1) final grade
inspection in connection with the corrective work.
F. If
it is determined through the video, inspection, that the lateral sewer
service line is not defective, the City shall refund the application
fee to the applicant, less the cost of having the lateral sewer service
line video inspected.
G. The
maximum amount that the City will pay for corrective work to an applicant
under this policy is four thousand dollars ($4,000.00), and any amounts
incurred in excess of four thousand dollars ($4,000.00) shall be the
sole responsibility of the applicant.
H. The corrective work which is subject to
reimbursement is limited to excavation, repair or replacement of the
line, backfilling and seeding and strawing the disturbed portion of
the yard.
I. The City has no obligation or responsibility
for the performance by the contractor and no responsibility for any
damages caused to the owner's property by reason of the sewer line
defects.

A. There is hereby assessed a sum up to twenty-eight
dollars ($28.00) annually on all residential property within the City
of St. Ann having six (6) or less dwelling units to provide funds
to pay the cost of certain repairs of defective sewer lines serving
such dwelling units.
B. The St. Louis County Collector shall collect
said fee annually by adding same to the general tax bills issued to
property owners within the City of St. Ann.
C. Said revenues, including any interest generated therefrom, shall be used only for the purpose of reimbursing the owners of residential properties containing not more than six (6) dwelling units for the repair of defective sewer service lines serving such property in accordance with the City of St. Ann Sewer Lateral Repair Policy, set out in Section
535.010 above.
D. The City of St. Ann shall be reimbursed
for the administration costs of the City's Sewer Lateral Repair Program.
Therefore, the City shall receive a twelve percent (12%) fee as reimbursement
for its administration costs associated with the Program. This twelve
percent (12%) fee is based on the total of both the annual tax revenue
generated pursuant to Sections 249.422 and 249.423, RSMo.
