All references made to any grade or elevations in the City shall
be measured from and based upon public bench marks established by
ordinance.

A. For
the purpose of this Section, "surplus property" means
real or personal property no longer needed, due to replacement or
obsolescence, in the operation of the City and property acquired by
lawful seizure or stolen or lost property recovered by agents of the
City and unclaimed by the real owner thereof.
B. Whenever
City staff has determined a piece of real or personal property is
no longer useful for City operations and said property in the opinion
of the staff is no longer necessary, staff shall petition the Board
of Aldermen for approval to sell said property.
C. When
property is declared to be surplus, the City clerk or her designee
shall advertise it for sale by posting a notice of sale on the entry
window of City Hall and by at least one (1) publication in a newspaper
having local circulation; and notice to be posted and published at
least thirty (30) days prior to the date of sale.
D. The
Board of Aldermen shall determine the date of sale, the estimated
value of the property to be sold and whether the sale of the surplus
property shall be by public auction, sealed bid or oral bid.
E. Property
valued at less than five hundred dollars ($500.00) may be sold if
only one (1) bid is received, provided the bid approximates the appraised
value of property. No sale of property valued in excess of five hundred
dollars ($500.00) will be made unless more than one (1) bid is received.
F. Receipt Of Bid — Award Of Sale — Payment Method. The City Clerk shall receive the bids and, with Board approval,
may award the sale to the highest bidder. The sale of all surplus
property irrespective of value shall be for cash or certified funds.
G. The
City reserves the right to reject all bids and shall reject same if
highest bid is not at least seventy percent (70%) of estimated value
of property being sold.
H. The
Board of Aldermen may elect not to sell surplus property and instead
donate same to a charitable organization. Said organization must be
in fact not-for-profit and shall provide certification of the same
to the City.

Any cash or security instrument received by the City shall be
deposited within forty-eight (48) hours of receipt. If for any reason
personnel believe that it cannot adhere to this Section, a written
explanation shall be provided to the City Administrator, prior to
the expiration of the forty-eight (48) hours. The City Administrator
may, at his/her discretion, hold a security instrument up to thirty
(30) days, if he/she believes that it is in the best interest of the
City. Under no circumstance shall cash be held in excess of seventy-two
(72) hours.

No employee of the City of Pine Lawn, Missouri shall issue a
permit of any kind to an individual or business that is delinquent
in payment of any tax or fee due and owing to the City of Pine Lawn,
Missouri, including trash fees payable to a third party for the benefit
of the City, unless authorized by the Board of Aldermen and the Mayor.
