A Board of Tourism is hereby created to make recommendations
to the Rock Port Board of Aldermen for expenditures of the monies
received from the tourism tax.

The Board of Tourism shall consist of nine (9) members who shall
be known as members. The members shall be appointed by the Mayor,
with the approval of the Board of Aldermen. One (1) member of the
Board of Aldermen, appointed by the Mayor, shall serve as liaison
in a non-voting capacity. All members shall be a resident of the City
or shall own a business in City limits and reside in Atchison County
and no member shall receive any compensation for their services.

The Board shall elect from its membership a Chairman and Vice
Chairman and any other officer it deems desirable and necessary. Officers
shall serve terms of one (1) year and may serve a maximum of two (2)
consecutive terms in each office.

The Board shall hold a minimum of nine (9) meetings annually
at a time and place to be determined by the Board. Five (5) members
shall constitute a quorum for the transaction of business.

The Board shall serve as an advisory board to the Board of Aldermen.

Every vacancy that may occur on the Board of Tourism shall be
reported to the Mayor and shall be appointed by the Mayor, with the
approval of the Board of Aldermen, in the same manner as is provided
in this Article for initial appointments. The persons so appointed
shall have the qualifications required for membership. Each appointment
to fill a vacancy shall be for the unexpired term.

The Board members shall serve for a term of three (3) years,
but of the members first (1st) appointed, one (1) shall be appointed
for a term of one (1) year, two (2) shall be appointed for a term
of two (2) years and two (2) shall be appointed for a term of three
(3) years. The Mayor, with the approval of the Board of Aldermen,
may remove a member at any time for misconduct or neglect of duty
or when in the opinion of the Mayor and Board of Aldermen such removal
would be conducive to the proper operation of the Board of Tourism.

The board may adopt additional bylaws to facilitate its governance
and operations as long as such bylaws are consistent with the terms
set forth in this legislation and with local, State and Federal laws
and regulations.

All monies received from the tax shall be deposited in a special
fund and used solely for funding a convention and visitors bureau
which shall be a general not-for-profit organization with whom the
City has contracted and which is established for the purpose of promoting
the City as a convention visitor and tourist center. Recommendations
may be made to the Board of Aldermen for approval of the expenditure
of the tourism tax monies. The Board of Aldermen will have the final
approval of all expenditures.
