As used in this chapter, the following terms shall have the
meanings indicated:
OUTDOOR WOOD BOILER
Any equipment, device, apparatus, or any part thereof, which
is installed, affixed, situated outdoors for the primary purpose of
combustion of wood fuel to produce heat or energy used as a component
of a heating system.
It is the intention of the Village Board of the Village of Whitesboro
by the adoption of this chapter to prohibit the construction, installation,
and operation of outdoor wood boilers within the limits of the Village
of Whitesboro for the purpose of securing and promoting the public
health, comfort, convenience, safety, and welfare of the Village and
its inhabitants and visitors. It is generally recognized that the
types of fuel used and the scale and duration of the burning by such
boilers create noxious and hazardous smoke, soot, fumes, odors and
air pollution, and can be detrimental to health, and can deprive persons
of the enjoyment of their property or premises.
Be it enacted as follows: No outdoor wood boiler may be constructed,
installed, or used within the Village of Whitesboro.
Any person who shall commit an offense against this chapter shall, upon conviction thereof, be punishable as provided in Chapter
1, General Provisions, §
1-11, General penalty.
