In order to regulate the use of the facilities in Fairmount
Park, Nitchkey Field and Vulcan Road Field within the Borough of Red
Lion, and to protect persons and property therein, no person shall
be permitted to enter or remain in Fairmount Park, Nitchkey Field
and Vulcan Road Field, including parking areas, between the hours
of sunset and sunrise, unless written permission is obtained from
the Mayor of Red Lion or authorization and approval is given by the
Red Lion Borough Council.

This prohibition shall not apply to persons lawfully present
for the use of the facilities of the Youth Center and Community Building,
provided that such access to the park is limited to the parking lot
located in the park between the water tank and the community building,
the parking lot facing South Charles Street and the area lying between
the Community Building and Fairview Street, as shown on a plan attached
hereto.

1. In order
to protect the health, safety and welfare of persons utilizing the
Red Lion Mile Recreation Trail, Fairmount Park and Nitchkey Field
within the Borough of Red Lion, smoking shall not be permitted by
any person on the Red Lion Mile Recreation Trail, in Fairmount Park
or in Nitchkey Field, including parking areas.
2. “Smoking”
shall mean and include inhaling, exhaling, burning, or carrying any
lighted cigarette, cigar, pipe, or other smoking equipment used for
tobacco or any other weed or plant.
3. “No
Smoking” signs, with letters of not less than one inch in height
and 3/4 inch in width, or the international “No Smoking”
symbol (consisting of a pictorial representation of a burning cigarette
enclosed in a red circle with a red bar across it) shall be clearly
and conspicuously posted at reasonable places and intervals along
the Red Lion Mile Recreation Trail, at the entrances to Fairmont Park
and Nitchkey Field, and at reasonable places and intervals along the
perimeter of the property; provided, however, that the absence of
a “No Smoking” sign shall not justify a violation of nor
preclude enforcement of this section.
4. Exceptions.
The Mayor or Borough Manager may, but is not required to, designate
smoking areas of appropriate size, provided the area must have a clearly
marked perimeter, be prominently marked with “Smoking Permitted”
signs, and be located the greatest distance practicable from buildings,
playground equipment, pedestrian walkways, and any parking areas.

The Borough Council of Red Lion Borough is hereby authorized
to prescribe rules and regulations for the use by the public of parks
and recreation grounds and the facilities connected therewith. Current
rules and regulations are hereby ratified, confirmed and readopted.
New rules shall be adopted by resolution and shall then be posted
at conspicuous places in the parks and recreation grounds.

Any person who shall violate any provision of this Part, upon
conviction thereof, shall be sentenced to a fine of not more than
$1,000 plus costs and, in default of payment of said fine and costs,
to a term of imprisonment not to exceed 30 days. Each day that a violation
of this Part continues or each section of this Part which shall be
found to have been violated shall constitute a separate offense.
