As used in this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:
ALUMINUM
Recyclable cans and containers fabricated from aluminum.
CONSTRUCTION/DEMOLITION DEBRIS
Concrete, brick, tree parts, nonferrous/ferrous metal, asphalt, and corrugated cardboard.
CORRUGATED PAPER
Structural material shipped in parallel furrows and ridges or rigidity, used to make packaging and shipping containers.
FERROUS SCRAP
All products made of metal, exclusive of aluminum, including washers, dryers, refrigerators, stoves, hot-water heaters, tire rims, springs, bicycles, bimetal cans (tin cans) or scrap metal.
GARBAGE
Putrescible animal, fish, fowl, fruit or vegetable waste incident to and resulting from the use, preparation, cooking and consumption of food.
GLASS
All products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling of various matter. Specifically included are clear, green and brown containers only. Specifically excluded are all other colored glass items and glass commonly known as "window glass."
HIGH-GRADE OFFICE PAPER
White paper and ledger paper, copier paper, carbonless computer printout paper, manila tab cards and file folders.
METAL
All products made of metal, exclusive of aluminum, including washers, dryers, refrigerators, stoves, hot-water heaters, tire rims, springs, bicycles and other similar metal products.
NEWSPAPERS
Paper of the type commonly referred to as "newsprint" and distributed at stated intervals, having printed thereon news and opinions and containing advertisements and other matters of public interest, and including magazines.
PLASTIC CONTAINERS
Type 1 [polyethylene terephthalate (PETE): soda and water containers, some waterproof packaging] and Type 2 [high-density polyethylene (HDPE): milk, detergent and oil bottles, toys and plastic bags].
TRASH
Ashes, plastic material, ceramics, blue and flat glass, nonputrescible solid waste, building materials, contaminated papers, unwanted furniture, cabinets and other similar materials.
WASTEPAPER PRODUCTS
All uncontaminated paper materials, such as books, paper, food cartons, cardboard boxes, wrapping paper, bags, discarded letters and envelopes and corrugated boxes and cartons.

There is hereby established within the Township of Washington a program for the mandatory separation of the following categories, as defined in § 415-7 which are hereafter referred to as the "Township recyclable materials."
A. 
For residential properties and buildings: aluminum, glass, newspapers, ferrous scrap, metal cans of steel and tin, plastic bottles, Type 1 and Type 2 plastic containers, except bottles previously containing contaminants, glass beverage containers, aluminum cans, leaves, white goods, tin cans, grass, mixed paper, corrugated cardboard, construction and demolition debris, and household-generated batteries.
B. 
For commercial properties and buildings: aluminum, glass, newspapers, ferrous scrap, corrugated paper and high-grade office papers, metal cans of steel and tin, plastic bottles, Type 1 and Type 2 plastic containers, except bottles previously containing contaminants, corrugated cardboard, glass beverage containers, white goods, aluminum cans, mixed paper and construction and demolition debris, which is defined in the definitions section hereof,[1] and includes source-separated, nonputrescible recyclable material generated from the construction, alteration, repair, maintenance and/or demolition of structures within the Township. This material shall include concrete bricks, block, ferrous and nonferrous scrap, asphalt, asphalt shingles, recyclable wood scrap and any and all other material generated from the construction, alteration, repair, maintenance and/or demolition of a structure or structures within the Township that the Township may deem recyclable.

All persons who are owners or occupants of any residential property or building thereon or any commercial property or building thereon within the Township of Washington shall separate the Township recyclable materials from any other trash or garbage produced by any such owner or occupant and shall separately bundle and bag the same for pickup, collection and recycling in accordance with the Township of Washington's approved recycling program. In the absence of a Township of Washington approved recycling program for any owner or occupant of any residential or commercial property or building within the Township of Washington, such owner or occupant shall establish and adhere to a private program for the picking up of materials for recycling, which program shall be subject to the prior approval of the Township of Washington Municipal Recycling Coordinator. With respect to owners or occupants of any residential property or building or persons who are owners or occupants thereof, said persons shall separately bundle and bag the Township recyclable materials for pickup, collection and recycling in accordance with the following regulations:
A. 
Aluminum and glass shall be commingled and shall be contained in a covered reusable metal or plastic occupant-or owner-supplied container.
B. 
Newspapers shall be assembled in bundles not to exceed 40 pounds each, such bundles to be securely tied, or placed in brown paper bags or corrugated boxes. No newspapers shall be placed in plastic bags.
C. 
Ferrous scrap shall be delivered to the Department of Public Works.

The collection, removal and disposal of the Township recyclable materials shall be scheduled and regulated by the enactment of resolutions from time to time by the Township Council with the advice of the Township's Recycling Coordinator.
All receptacles required herein shall be supplied by the occupant and/or owner of the premises, and all recyclable material receptacles shall be placed, no earlier than 6:00 p.m. of the day prior to scheduled collection, on the premises of the occupant and/or owner no more than 10 feet behind the curb or edge of the roading, where they shall be readily accessible to the collector. The occupant and/or owner shall keep all receptacles clean and in condition for safe handling. After collection, any empty containers shall be removed promptly, but not later than 7:00 p.m. of the day of collection.
From the time of placement behind the curb or roadway of the Township recyclable materials for collection in accordance with resolutions of the Township of Washington in accordance with the terms hereof, the Township recyclable materials shall be and become the property of the Township of Washington or its authorized agent. It shall be a violation of this article for any person unauthorized by the Township of Washington to collect or pick up or cause to be collected or picked up any such materials. Any and each such collection in violation hereof shall constitute a separate and distinct offense punishable as hereinafter provided.
Any person who violates any provision of this article and the rules and regulations issued pursuant thereto shall be subject to the following penalties: for first and second violations, a warning shall be issued; for third and fourth violations, a person shall be subject to a fine of not more than $50; for fifth and sixth violations, a person shall be subject to a fine of not less than $50 nor more than $100; and for each violation thereafter, a person shall be subject to a fine of not less than $500 nor more than $1,000.

This article and each provision hereof shall be enforced by the Municipal Recycling Coordinator, the Department of Police, the Department of Health and the Department of Public Works, which have concurrent jurisdiction, and each of which shall be authorized to have a summons issued for any violation of the article.
The program established by § 415-8 shall be commenced August 1, 1988, and shall be conducted in accordance with applicable regulations of all governmental agencies having jurisdiction of the mandatory statewide recycling program of the State of New Jersey as it pertains to municipalities. Any such regulations shall be approved by the Township Council and may be changed, modified, repealed or amended in whole or in part by the Township Council to the extent permitted by law. A copy of any such regulation, as approved, modified or amended, shall be available for public inspection at the office of the Clerk during regular office hours.
No provision contained in this article shall be construed to prohibit the picking up of materials for recycling if otherwise authorized by law; provided, however, that such action shall not conflict or interfere with the pickup and collection by the Township of Washington and its duly authorized agents of the Township recyclable materials.
