As used in this article, the following terms shall have the meanings indicated:
DUMPSTER
A device or container one cubic yard or more in size used or intended for the use of bulky waste, construction debris, refuse and like materials.
TEMPORARY CONSTRUCTION DUMPSTER
A dumpster that is used in connection with construction, demolition or for similar temporary means and requires a dumpster license, which license shall be issued for a period not to exceed 30 days, renewable for additional thirty-day periods upon application, not to exceed a total period of 12 months.
A. 
All dumpsters are to be placed on a permanently paved surface and screened to a height of six feet with solid fencing providing one-hundred-percent opacity on all sides. An additional self-closing pedestrian access gate is also required.
B. 
An owner or lessee of property shall place or maintain a dumpster so that it is not visible from the street right-of-way on the address side of the property. A dumpster located on a service drive behind a building on said property shall not be deemed visible from the street right-of-way.
C. 
A dumpster shall be deemed to be visible only if it can be seen by any person who is standing at grade level on any part of the right-of-way of a public street having a right-of-way width of 40 feet or more that adjoins the address side of the property on which the dumpster is located.
D. 
Existing dumpsters shall comply with the above restrictions immediately upon enactment of this article.
A. 
Screening is not required on a side adjacent to an alley or easement used for garbage pickup service.
B. 
A temporary construction dumpster is permitted and shall be exempt from screening requirements at an active construction site upon application for and approval of a dumpster license and under the following conditions:
(1) 
The dumpster shall be located on private property;
(2) 
If necessary to locate the dumpster in the street, a right-of-way permit is required; and
(3) 
The dumpster shall not create a sight, traffic or safety obstruction.
Any person, persons, firm or corporation who shall violate any of the provisions of this article shall, upon conviction thereof, be punishable by a fine of not less than $50 nor more than $500 together with the costs of prosecution and, in default of the payment of the fine and costs, by imprisonment for a term not to exceed 30 days. Such fine and penalty may be collected by suit brought in the name of the Borough before any Magisterial District Judge in like manner as debts of like amount may be collected by existing laws. Each day that a violation is permitted to exist shall constitute a separate and distinct offense.
