This article is adopted pursuant to the provisions of New York State Municipal Home Rule Law § 10, which grants to local governments the authority to enact local laws which are not inconsistent with the New York State Constitution or general laws. This article recognizes that New York State Public Officers Law § 3 was rendered a special law with respect to the residency requirements for the office of the Deputy Superintendent of Highways by the addition of § 3, Subdivision 24.
This article shall supersede § 23 of the New York State Town Law insofar as it is inconsistent with such section.
The person holding the Office of Deputy Superintendent of Highways in the Town need not be a resident or elector of the Town, provided that such person resides within the County of Suffolk.
This article shall take effect immediately.
