Any person who owns a dog, cat or other animal susceptible to
rabies which has bitten a person, is to confine the animal as hereinafter
provided for a period of not less than 10 days from the day of the
bite.
The Township Health Officer shall serve notice upon the owner
or person in charge of such animal the provisions of this section
and any other applicable ordinance or law. Such notice shall be in
writing and shall be served personally, or, if personal service cannot
be accomplished, by mail addressed to the owner or person in charge
of such animal. If such owner or person is not known, the notice shall
be effective if addressed to the occupant of the premises upon which
the animal is located.
The animal is to be confined upon the premises of the owner
or person in charge. In the event the animal is found off the premises
during the period of confinement, or in the event the animal has previously
been confined pursuant to this section or any previous ordinance or
regulation relating to bites by the animal, then the animal is to
be confined at the expense of the owner or person in charge thereof
at a place designated by the Health Officer for the full period of
confinement or the balance thereof.
An animal confined pursuant hereto is not to be released from
confinement until a certificate of release is issued by the Health
Officer.
Any person who violates any provision of this section shall
be liable to penalties as provided for pursuant to the provisions
of N.J.S.A. 26:4-94.
Nothing in this section shall be construed to limit or restrict
the provisions of the laws of the state applicable to animal bites
and rabies control, or any supplemental ordinances or resolutions
adopted by the Township.
