All buildings and structures, and all parts
thereof, shall be maintained in a safe, sanitary and nonhazardous
manner. All means of egress, devices, safeguards and equipment shall
be kept in good working order. The exterior of all premises and the
condition of all buildings, structures and components thereon shall
be maintained so as to prevent and repair deterioration, so that the
appearance thereof shall reflect a level of maintenance in conformity
with all applicable ordinances of the Town of Selbyville and so as
to insure that the property itself may be preserved safely and that
hazards to public health and safety are avoided.
Within a period of 30 days after casualty damage
to any premises, the owner and operator shall take the following steps:
A. Contract for the repair and restoration of damaged
areas and removal of debris; and
B. Contract for the demolition and removal of any part
of the premises not to be repaired and restored and for the removal
of debris in connection therewith.
Any owner of property violating any of the provisions
of this article shall be deemed guilty of a misdemeanor and, upon
conviction in a court of competent jurisdiction, shall be fined not
less than $25 nor more $100 or imprisoned for a term of not more than
20 days, or both, and shall pay the costs of prosecution, including
Town attorneys' fees, and Victims' Compensation Fund assessment. For
the purposes of this article, each day thereof that a violation continues
shall be deemed to be a separate offense. In addition to any other
remedy provided for in this article, and because the purpose of this
article is to safeguard and protect the public health, safety and
general welfare of the property owners and residents of the Town of
Selbyville, the Town Administrator is hereby authorized to bring an
action in a court of competent jurisdiction to enjoin any violation
of the provisions of this article.
