There is hereby established in the Township of South Hackensack a State Uniform Construction Code Enforcing Agency to be known as the "South Hackensack Uniform Construction Code Enforcing Agency," consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the Enforcing Agency. The members of said Enforcing Agency shall be appointed by the Township Committee for such terms of office as may hereafter be established and shall serve without salary unless otherwise provided in the Salary Ordinance of the Township of South Hackensack.[1] In addition to the enforcement officer named herein, the enforcement officer of the Health Code either duly appointed by the Board of Health of this Township or whose services are provided under a contract with this Township for the provision of public health services shall, in the course of his or her duties in the enforcement of the Health Code, also be authorized to enforce the Property Maintenance Code of this Township.

There is hereby established a Construction Board of Appeals to hear appeals from decisions by the Enforcing Agency. Such Board shall consist of five members. At least one Board member shall be a registered architect or licensed professional engineer of building construction experience, and at least one Board member shall be as qualified as a Plumbing Subcode Official and one as qualified as an Electrical Subcode Official. No more than two Board members shall be selected from the same business or profession. Each Board member shall have had at least three years' experience in construction, design or supervision as a licensed engineer or registered architect or, in the alternative, five years' experience in construction, design or supervision as an architect or engineer with a bachelor's degree in architecture or engineering, respectively, from an accredited institution of higher education or, as a further alternative, 10 years' experience in construction, design or supervision as a journeyman in a construction trade or as a construction contractor, subcontractor or inspector. The members of said Construction Board of Appeals shall be appointed by the Township Committee for such terms of office as may hereafter be established and shall serve without salary unless otherwise provided in the Salary Ordinance of the Township of South Hackensack.

The fee for a construction permit for any and all work under the Township's Construction Code shall be the sum of the subcode fees as provided in Chapter 108, Fees, which permit fee shall be payable before the permit is issued.
Each subcode official shall make a monthly report to the Construction Code Official, who shall make his or her monthly consolidated report to the Township Committee showing the fees collected for all work done under this chapter.

The Construction Official and all subcode officials, in the course of their duties under this chapter or the State Uniform Construction Code and all adopted subcodes or any other chapter of the Code of the Township of South Hackensack, when required to make a determination in respect to compliance with any zoning requirement of this Township, shall do so in consultation with the Zoning Enforcement Officer of the Township of South Hackensack.

No permit or certificate shall be issued by the Construction Official or any subcode official under this chapter or the codes or regulations adopted by reference pursuant to this chapter if the undertaking for which each such permit or certificate is sought involves the application of either or both the Zoning Chapter and Subdivision and Land Development Chapter unless and until a determination has been made by the Zoning Enforcement Officer of the Township of South Hackensack that such undertaking complies with the terms and conditions of either or both of those two chapters.

A. 
Appointment and term. The Township Committee may appoint a Technical Assistant and establish hours for said position to serve the Construction Department. The term of said appointment shall commence upon appointment by the Township Committee and terminate one year thereafter. The Technical Assistant shall have and maintain certification by the Department of Community Affairs, Division of Codes and Standards.
B. 
Duties of the Technical Assistant. The Technical Assistant shall perform such duties as those defined by the Department of Community Affairs, Division of Codes and Standards, as said regulations may from time to time be amended. The Technical Assistant shall work at the direction of the Construction Official and assist in performing all tasks necessary to implement the State Uniform Construction Code.
C. 
Compensation. The Technical Assistant shall receive such compensation as set by the Township Committee in the Salary Ordinance.
