Artificial light in private garages shall be by incandescent electric light only.
Unless expressly permitted by the Board of Trustees, not more than five gallons of gasoline, exclusive of that in the tanks which constitute a part of vehicles, shall be kept in a private garage. Gasoline shall be kept only in approved safety containers.

A. 
Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
B. 
In addition or as an alternative to the above-provided penalties, the Board of Trustees may also maintain an action or proceeding in the name of the Village in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this article.

Before constructing or altering any public garage, complete plans of such proposed work shall be filed with and approved by the Building Inspector. No structure shall be used as a public garage without a license.

Public garages shall be fireproof, semifireproof or heavy timber construction as required by the authority herein empowered to approve the plans thereof and in compliance with all the provisions of the New York State Uniform Fire Prevention and Building Code and Chapter 305, Stormwater Management and Erosion and Sediment Control, of the Village of Babylon Code.
A public garage located in or attached to a building occupied for any different purpose shall be separated from such other occupancy by walls, floors and ceiling having a fire-resistance rating of not less than two hours. Walls, floors and ceilings which effect such separation shall be continuous and unpierced by openings, provided that door openings equipped with self-closing fire doors leading to sales rooms or offices operated in connection with such garages shall not be prohibited, and provided also that the use of elevators and stairways to other stories accessible only by vestibules or balconies constructed and arranged as required for fire towers shall not be prohibited. Public garages containing gasoline for sale and carbon or lead burning, welding or other processes involving open flame or spark-emitting devices or the use of machine tools shall not be connected with any residence building.
Garages located in buildings with parts above the garage used for other purposes shall be protected by automatic sprinklers when such garages are able to contain 20 or more passenger automobiles or are used as bus terminals with a capacity of more than two buses or are used for the storage and loading of two or more trucks.
Basements used as public garages shall be continuously ventilated by mechanical ventilating systems so constructed as to assure suitable dilution and removal of gasoline vapors and motor exhaust fumes.
Carbon and lead burning, welding and other processes involving direct application of flame shall be carried on in the open air not less than 10 feet from any building or in a special closed machine of approved type or in a special room separated from the rest of the garage by two-hour partitions.
Volatile flammable liquids shall not be used for cleaning purposes in a garage unless in a special closed machine of approved type or in a special room separated from the rest of the garage by two-hour partitions.
Gasoline and other volatile flammable liquids shall not be allowed to run upon the floor or to fall or pass into the drainage system of the premises. Self-closing metal cans shall be used for all oily waste or wasted oils. Garages shall be swept frequently and kept clean.
Exclusive of that in the tanks of vehicles, gasoline shall be kept at a public garage only in underground tanks or in approved safety cans or in approved portable wheeled tanks not exceeding a capacity of 60 gallons each. The gasoline tanks of vehicles shall be filled directly through hose from pumps attached either to portable storage tanks or to permanent filling stations connected to underground storage tanks. Gasoline shall not be handled in any open container.
In every public garage two or more approved chemical fire extinguishers and four or more pails of sand shall be kept convenient for quick use in case of fire.
Sections 183-5, 183-6, 183-7 and 183-8 of this article shall apply only to public garages constructed or altered after the adoption of this article.
