The Board of Trustees of the Village of Babylon
hereby finds that the sidewalks of its Retail Business District are
subject to a large pedestrian traffic flow. In order to provide for
the safety of pedestrians of all ages using such district, it is necessary
to limit the operation of skateboards, in-line skates, roller skates,
scooters, hoverboards, and/or any motorized personal transport device.
For the purpose of this chapter, the following
terms shall have the meanings indicated:
HOVERBOARD
A single platform which is mounted on wheels, propelled by
either electric batteries or a gas-generated motor.

IN-LINE SKATES
Shoes or boots to which there are attached one or more wheels
in tandem for purposes of supporting said shoes or boots and providing
locomotion thereto.
ROLLER SKATES
Shoes or boots to which there are attached wheels for purposes
of supporting said shoes or boots and providing locomotion thereto.
SCOOTER
A long footboard between end wheels controlled by an upright
steering handle attached to the front wheel.
SKATEBOARD
A single platform which is mounted on wheels, having no mechanism
or other device with which to steer or control the direction of movement
thereof while being operated, used or ridden.

No person shall use or ride upon any device designated in §
295-2, Definitions, on any sidewalk on the south side of Main Street between the corner formed by the intersection of the south side of West Main Street and the east side of Carll Avenue to the west side of Willow Street, and on the north side of Main Street from the corner formed by the intersection of the north side of West Main Street and the east side of Carll Avenue to the west side of Cooper Street, and on the east and west sides of Deer Park Avenue from Main Street north to the south side of Railroad Avenue on the west side of Deer Park Avenue and on the east side of Deer Park Avenue from Main Street to the south side of George Street, and on Grove Place on the north and south sides from North Carll Avenue to Deer Park Avenue, and any other locations in the Retail Business District, as well as at the Village Gazebo located on the south side of Main Street.
Furthermore, no person shall use, operate or
ride any skateboard in any other place within the Village of Babylon
in such an unsafe or dangerous manner as to put himself, herself or
others in danger of death or serious bodily injury.
Proper signs designating those areas in which
skateboard riding is prohibited shall be posted as deemed appropriate
within the discretion of the Village Board.
Violations of this chapter shall result in punishment,
upon conviction, by a fine not exceeding $250 or by imprisonment for
a term not exceeding 15 days, or by both such fine and imprisonment.
In the case of a second conviction under this chapter, the skateboard,
in-line skates, roller skates or scooter may be confiscated.
