Unless any other provisions of the Revised General
Ordinances of the Township of Howell, New Jersey, or state statute
provides for a different penalty, violation of any provision of said
codified ordinances or this Code, which shall be included herein,
where no specific penalty, upon conviction, shall be a fine not exceeding
$2,000 or imprisonment for a term not exceeding 90 days or a period
of community service not less than 10 days nor more than 90 days,
in the discretion of the court, provided further that for a violation
of any particular ordinance at least a minimum penalty of a fine of
$100 shall be imposed. The penalty for a violation of the codified
ordinances pertaining to unlawful solid waste disposal shall be subject
to at least a minimum penalty which shall consist of a fine fixed
at an amount not exceeding $2,500 or a maximum penalty by a fine not
exceeding $10,000.
Any person who is convicted of violating an ordinance
within one year of the date of the previous violation of the same
ordinance and who was fined for the previous violation shall be sentenced
by the court to an additional fine as a repeat offender. The additional
fine imposed by the court upon the person for a repeated offense shall
not be less than the minimum or exceed the maximum fine fixed for
a violation of the ordinance, if any, but shall be calculated separately
from the fine imposed for the violation of the ordinance.
Any person convicted of the violation of any ordinance
may, in the discretion of the court by which he was convicted, and
in default of the payment of any fine imposed therefor, be imprisoned
in the county jail or place of detention provided by the municipality
for a term not exceeding 90 days or be required to perform community
service for a period not exceeding 90 days.
Except as otherwise provided, each and every day for
which a violation of any provision of the aforesaid codified ordinances
or this Code, or any other ordinance of the Township, exists shall
constitute a separate violation. In case of a fine imposed upon a
corporation, the fine and costs may be collected in a civil action
or in such manner as may be provided by law.
