In case of a natural or accidental disaster
or civil disorder or any other unusual peril to the health, welfare
or safety of the people of the City of Kingston, it shall be the right
and duty of the Mayor, upon the advice of or with the concurrence
of any two of the following, to wit: President of the City Council,
any alderman, Chief of Police, Fire Chief, Building Safety Officer,
City Engineer and/or the Commissioner of the Board of Water Supply,
to declare a state of emergency and summon all of the forces of the
different departments and/or agencies of the city for the purpose
of protecting the lives and property of the citizens of the City of
Kingston, and the Mayor shall have power to summon deputies or otherwise
employ such other persons as he may deem necessary for the purpose
of rendering protection to the citizens of the City of Kingston.
For the purpose of this chapter, the terms listed
below shall have the following meanings:
MAYOR
The Mayor of the City of Kingston.
ORDINANCE
Any provision of the City Charter or any local ordinance
enacted thereunder.
MOLOTOV COCKTAIL
A bottle or other container, with or without a fuse-tied
wick inserted therein, containing gasoline or any other inflammable
or explosive material.
During the period of a declared state of emergency,
the Mayor shall have the power to enforce any or all of the following
provisions:
A. Alcoholic beverages. No person shall consume any alcoholic
beverages in a public street or place which is publicly owned, or
in any motor vehicle driven or parked thereon which is within a duly
designated restricted area.
B. Weapons. No person shall carry or possess any rock,
bottle, club, brick, Molotov cocktail or weapon who uses or intends
to use the same unlawfully against the person or property of another.
C. Restricted area. The Mayor may, in such declared emergency,
restrict travel in or out of the city limits through the imposition
of reasonable regulations governing the same.
Should the Mayor deem it necessary to invoke
any or all of the above provisions of this chapter, he shall be required
to give notice of the same by means of a written proclamation issued
to news media for immediate dissemination to the public.
During the period of a declared state of emergency,
the Mayor shall have the power to declare a curfew, during the hours
of which no person shall be allowed in the public streets or places
throughout the City of Kingston, New York, or in any designated sections
of the same.
A violation of any provision of this chapter
shall be punishable by a fine not exceeding $1,000, or by imprisonment
not exceeding 180 days, or by both such fine and imprisonment, or
by a penalty of not less than $5 nor more than $1,000, to be recovered
by the City of Kingston in a civil action.
