The purpose of this chapter is to provide for
the health, safety, and general welfare of the citizens of the City
of Kingston through the regulation of nonstormwater discharges to
the municipal separate storm sewer system (MS4) to the maximum extent
practicable as required by federal and state law. This chapter establishes
methods for controlling the introduction of pollutants into the MS4
in order to comply with requirements of the SPDES General Permit for
Municipal Separate Storm Sewer Systems. The objectives of this chapter
are:
A. To meet the requirements of the SPDES General Permit
for Stormwater Discharges from MS4s, Permit No. GP-02-02, or as amended
or revised;
B. To regulate the contribution of pollutants to the
MS4 since such systems are not designed to accept, process or discharge
nonstormwater wastes;
C. To prohibit illicit connections, activities and discharges
to the MS4;
D. To establish legal authority to carry out all inspection,
surveillance and monitoring procedures necessary to ensure compliance
with this chapter; and
E. To promote public awareness of the hazards involved
in the improper storage and/or discharge of trash, yard waste, lawn
chemicals, pet waste, wastewater, grease, oil, petroleum products,
cleaning products, paint products, hazardous waste, sediment and other
pollutants into the MS4.
In accordance with § 10 of the Municipal
Home Rule of the State of New York, the Common Council of the City
of Kingston has the authority to enact local laws and amend local
laws for the purpose of promoting the health, safety or general welfare
of the City of Kingston and for the protection and enhancement of
its physical environment. The Common Council of the City of Kingston
may include in any such local law provisions for the appointment of
any municipal officer, employees, or independent contractors to effectuate,
administer and enforce such local law. The municipality designates
the City Engineer as the Stormwater Management Officer, who shall
accept and review all stormwater pollution plans. All plans must be
prepared by a licensed professional and conform to requirements of
this chapter.
This chapter shall apply to all water entering
the MS4 generated on any developed and undeveloped lands unless explicitly
exempted by an authorized enforcement agency.
