It shall be unlawful to maintain or operate any loudspeaker or amplifier connected with any device by which sounds are magnified and made heard over any public street or public place without first having secured a permit therefor.
The fee for licenses to be granted under this chapter shall be as follows:
A. 
For the use or operation of any sound amplifier or any similar device to be operated from a fixed location and not in a moving vehicle which transmits or broadcasts sound to be heard in a public street or public place: $100 for any day or part of a day for which the licensee desires to be licensed hereunder.
B. 
For the use of any sound amplifier or other similar device to be used in a moving vehicle along the streets: $25 for any day or part of a day for which the licensee desires to be licensed hereunder.
Any person, firm or corporation desiring a license for the use or operation of such device shall file an application therefor with the Secretary of the Borough of Media, upon a form provided by him, setting forth the name and address of the applicant, the name of the owner of such amplifying device, the date on which it is intended to be used and any other such information as may be prescribed.
Such license shall be issued upon the payment of a license fee, as above provided, to the Secretary of the Borough of Media, which license shall permit the use of such sound-amplifying device, subject to the terms and conditions of this chapter, only upon the date specified on such license and no other.
The license for the use of a sound-amplifying device either in a fixed location or in a moving vehicle may be issued without payment of the accompanying fee upon application by any public or municipal body or any nonprofit or charitable organization. Nothing herein is intended to require licensing of the use of sound-amplifying devices used by police or firemen in emergency situations.
A. 
No licensee shall use or operate or employ any such device within the borough limits on Sunday or after the hours of 8:00 p.m. prevailing time of any day, and no licensee shall use, operate or employ any such device within the radius of 500 yards from any church or other houses of worship while funeral services are being held there.

B. 
No licensee shall cause or permit to be emitted from any sound-amplifying device any lewd, obscene, profane or indecent language or any false representation of any matter, product or project advertised thereby, the sale of which is prohibited by any law, ordinance or statute.

Any violation of this chapter, either by a licensee violating limits of the use of the device as stated herein or by any person(s) or corporation in using a sound-amplifying device without first securing a license therefor, shall be subject to a fine not exceeding $600, plus costs of prosecution for each violation and, in default of payment of such fine and costs, by imprisonment for a period not exceeding 90 days.
