From and after the enactment of this chapter, no person, persons, firm
or corporation, shall move into or occupy any building or part of a building
within the Borough of Dravosburg, nor shall any person or persons move out
of or vacate any building or part of a building within the Borough of Dravosburg,
without first securing from the Borough Secretary a permit of occupancy or
a permit of vacancy, as the case may be, for occupying or moving out of or
vacating any building or portion thereof.
The provisions of §
200-1 shall not apply to the occupancy or vacation of rooms, suites, or other portions of motels, hotels, rooming houses, or the like, wherein rooms are rented on a daily basis to nonresidents of the Borough of Dravosburg.
The occupancy permit or vacancy permit, as the case may be, shall be
issued by the Borough Secretary upon proper application to the Borough Secretary
by the person, persons, firm or corporation desiring to occupy any building
or portion thereof within the Borough of Dravosburg. The said permit shall
be issued, without charge, upon proper registration and application therefor
by the person, persons, firm or corporation wishing to occupy or vacate any
premises within the Borough of Dravosburg.
Before issuing an occupancy permit or a vacancy permit, as the case
may be, the Borough Secretary shall check the records of the Borough of Dravosburg
to determine that the sewage charges for the premises to be occupied or vacated
have been paid. In the event that the charges have not been paid, no occupancy
permit or vacancy permit shall be issued until such time as the charges are
paid or a bond in the amount of the unpaid charges shall have been posted
by the person, persons, firm or corporation requesting said occupancy permit
or vacancy permit.
It shall be a violation of this chapter for any person, persons, firm
or corporation to move into and occupy, or to move out of or vacate, any premises
in the Borough of Dravosburg without having first secured an occupancy permit
or vacancy permit, as the case may be. From the date of the enactment of this
chapter, it shall be a violation thereof for any person or persons to have
moved into the premises without having applied for said occupancy permit,
and each day of occupancy without a permit shall be considered a separate
offense and shall be punishable by the provisions of this chapter.
Any person, persons, firm or corporation, or officer thereof, violating
the provisions of this chapter shall, upon conviction thereof before the Mayor
or District Justice, be sentenced to pay a fine of not more than $600, plus
costs of prosecution, and, in default of payment of such fine and costs, to
imprisonment for a term not to exceed 30 days.
