Upon a determination by the Mayor that there
is a clear and present danger to health, life or safety of the people
or property in any part of the Town of Middletown, the Mayor may issue
a proclamation declaring a state of emergency and may impose such
restraints, regulations and requirements, including but not limited
to periods of curfew or limitations upon the congregating of persons
in streets, roads, parks or public open spaces or limitation upon
the carrying or stockpiling of firearms, weapons and/or ammunition
as in his judgment are proper in order to protect and preserve the
health, life and safety of the people and property in the Town of
Middletown.
Any proclamation, restraints, regulations and requirements issued pursuant to §
65-1 shall have the force and effect of law, provided that the Mayor and Council may by resolution nullify or modify such proclamations, restraints, regulations or requirements.
The powers provided by this chapter may also
be exercised by the Vice Mayor in the absence from the Town of the
Mayor.
Upon authorization by the Mayor, the Chief of
Police, in order to meet anticipated or actual emergency conditions
in the Town of Middletown, may appoint and swear in persons with prior
police training or experience as temporary Town police who shall serve
during such anticipated or actual emergency and may be paid such compensation
and employment benefits as shall be fixed by the Mayor,
not to exceed the compensation and employment benefits provided for
full Town police under like circumstances.

Whoever violates any proclamation, restraint,
regulation or requirement issued hereunder shall, upon conviction,
be fined $75 and shall forfeit any weapon, firearm, ammunition or
other items to be seized at the time of arrest and retained until
final disposition of the charge.
