The Village Board of Trustees enacts this Article for the purpose of
abolishing the Village Department of Public Safety and with it the office
of Public Safety Administrator, which Department and position were previously
created by L.L. No. 4 of 1976, as amended by L.L. No. 3 of 1977. The Village
Board of Trustees is further desirous, by the enactment of this Article, of
creating the office of Chief of Police of the Albion Village Police Department,
said Chief of Police to act as chief administrator of said Police Department.
The Department of Public Safety of the Village of Albion and the office
of Public Safety Administrator, as established by L.L. No. 4 of 1976, as amended
by L.L. No. 3 of 1977, are hereby abolished. The heretofore mentioned local
laws which created said Department and position of Public Safety Administrator
are hereby rescinded in their entirety.
The aforementioned local laws, by their terms, abolished the position
of Chief of Police and transferred the duties of the Chief of Police to the
Public Safety Administrator. The office of Chief of Police of the Albion Village
Police Department is hereby reestablished. The office of Chief of Police shall
be a full-time appointed position subject to the Civil Service Law of the
State of New York with respect to termination of the position, appointment
or termination of the individual serving in the position, disciplinary action,
grievances, etc. The classification of the Chief of Police position and the
qualifications for the office of Chief of Police and the duties and responsibilities
of the Chief of Police shall be established by the Civil Service
Commission of the State of New York upon such Civil Service Commission approving
and certifying the position of Chief of Police, as submitted by the Village
Board of Trustees or as modified by said Civil Service Commission in a manner
acceptable to the Village Board of Trustees.
This Article shall take effect upon the filing and posting pursuant
to the laws of the State of New York, subject, however, to the approval and
certification of the position of Chief of Police by the New York State Civil
Service Commission.
