No building shall be moved unless a permit therefor has been obtained
from the Code Enforcement Officer or the Village Board. The permit may contain
such conditions as may be considered essential to protect the health, welfare
and safety of the community. The cost of each permit shall be as set by resolution
of the Board of Trustees from time to time. No permit shall be issued to move
a building to a site in the village unless site plan approval has been granted
by the Planning Commission and, in case the building in its new location is
nonconforming with respect to zoning, a variance has been obtained from the
Zoning Board of Appeals.
A.
No person, persons or corporation shall at any time move
any building or part of a building through, over or upon any of the public
streets, alleys or lanes in the village unless by permission, in writing,
of the Board of Trustees. Every applicant for such permission shall be required
to present a petition to the Village Board, and every such petition must set
forth the name of the street or streets over or upon which the applicant intends
to move such building, the place from and to which he/she intends to move
the same and the length of time it is expected to take for the entire job.
Said petition must be verified before the Village Board may act thereon. If
it is proposed to move a building over a state or county highway, the Village
Board will not grant permission until it is satisfied that permission has
been granted or will be granted by the New York State Department of Transportation
and/or the Albany County Department of Public Works, as applicable.
B.
Failure to obtain such permission shall be punishable
by a fine of not more than $250 or by imprisonment for not more than 15 days,
or both.
As used in this chapter, the following terms shall have the meanings
indicated:
