It is hereby granted, pursuant to the authority created by § 130 of the Town Law of the State of New York, that the establishment of certain visiting hours, rules and regulations for the use of the Old Hurley Cemetery situated off of old Route 209 in the Village of Old Hurley are necessary for the protection of the cemetery, it being the property of the Town of Hurley. Therefore, the provisions hereinafter prescribed are enacted in the public interest, and their necessity is hereby declared as a matter of legislative determination.
A. 
It shall be unlawful for any person to be within said cemetery, for any purpose, between the hours of 8:30 p.m. and 9:00 a.m.
B. 
It shall be unlawful for any person to drive or have under his or her charge, or under his or her control, or to park any vehicle, including motorcycles, trail bikes, snowmobiles or bicycles, in or upon said cemetery property, unless said vehicles are there for the usual purpose of cemetery operation and maintenance.
C. 
It shall be unlawful for anyone to bring or ride a horse into the cemetery.
D. 
It shall be unlawful for any person at any time to be upon said cemetery property, unless it is for the purpose of cemetery business, maintenance or visiting grave sites.

Any person or corporation who violates any of the provisions of this chapter shall be guilty of a violation, and any person convicted of such violation shall be liable to a penalty of not more than $50 for the first violation and conviction, or not more than 10 days in jail, or both; and for a second or subsequent violation and conviction within 18 months, a penalty of not less than $100 nor more than $200, or not more than 15 days in jail, or both.
