Due to the recent renovations to the building, sidewalk, roadway and parking lot that have occurred at the Washington Town Center, formerly known as the "Washington Township Shopping Center," a privately owned commercial complex containing parking areas and parking places that are open to the public, the Township Council hereby finds it necessary to revise the local ordinances within this article that pertain to the vehicular and pedestrian traffic and the parking of vehicles which occur on this property. It is the purpose of the Township Council, by the revisions to this article, to regulate traffic and the parking of vehicles in the parking areas and parking places of the Washington Town Center, and thereby preserve and safeguard the public health, safety and welfare.
Whenever used in this article, the following terms shall be deemed and construed to have the following meanings:
BICYCLE
A device having a wheel or wheels with pneumatic tires connected by a frame and arranged to be propelled exclusively by human power.
COMMERCIAL VEHICLE
As defined in Title 39 of the New Jersey Revised Statutes (N.J.S.A.), and § 223-1B.
HANDICAPPED PARKING
That area of the Washington Town Center so designated on the Washington Town Center Map (hereinafter referred to as the "Washington Town Center Map") and marked with signs and pavement markings giving notice thereof as shown on the Washington Town Center Map.
LOADING ZONE
That area of the Washington Town Center so designated on the Washington Town Center Map and marked with signs and pavement markings or bay doors attached to the building, giving notice thereof as shown on the Washington Town Center Map.
MOTORIZED BICYCLES
A bicycle having a helper motor characterized in that either the maximum piston displacement is less than 50 cubic centimeters or said motor is rated at no more than 1.5 brake horsepower, and said bicycle is capable of a maximum speed of no more than 25 miles per hour on a flat surface, and includes mopeds.

ROLLER BLADES, ROLLER SKATES, SCOOTERS and SKATEBOARDS
Those devices that contain wheels that are affixed to shoes, boots or boards that are generally propelled by human power, but may also be powered by an assist motor, and including go-peds and no-peds.
TRAFFIC AISLES
Those lanes of traffic located in between parking stall lanes that allow traffic to travel east, west, north and south in the parking lots located on the west side of the building.
TRAVEL LANES
Those lanes of traffic designated on the Washington Town Center Map for the purpose of allowing vehicles to travel north and south along the east and west sides of the building and east and west along the north and south sides of the building.
VEHICLES
Every device in, upon or which a person or property is or may be transported upon a roadway, excepting devices moved by human power, bicycles and motorized bicycles.
WASHINGTON TOWN CENTER
That complex of commercial buildings and appurtenant access and parking areas located on Pascack Road and designated as Block 3402, Lots 18, 19 and 20, and Block 3403, Lots 1 and 2, on the Tax Assessment Map of the Township of Washington (formerly known as the "Washington Township Shopping Center").
WASHINGTON TOWN CENTER MAP
That certain map of the Washington Town Center annexed hereto and made a part hereof entitled "Washington Town Center Map" revised as of May 20, 1999, and April 11, 2000, sometimes referred to as "Plan No. 1."[1]

A. 
Vehicles. No vehicle shall park or stand in a zone prohibiting same. No vehicle shall park in any area of the Washington Town Center except in parking stalls as designated on the Washington Town Center Map and marked with pavement markings giving notice thereof as shown on said map. No vehicle shall park, stop or stand in a zone prohibiting same.
B. 
Fire zones. No vehicle shall park, stop or stand in any roadway or traffic lane so designated by sign as a fire zone.
C. 
Bicycles and motorized bicycles. No bicycle or motorized bicycle shall park, stop or stand in a no-parking or no-standing zone. No bicycle or motorized bicycle shall park in any area of the Washington Town Center except in such areas as are specifically designated for same on the Washington Town Center Map and marked with either pavement markings or bicycle racks giving notice thereof as shown on said map.
D. 
Handicapped parking. No vehicle, bicycle or motorized bicycle shall park, stop or stand in any handicapped parking area, except vehicles bearing New Jersey State approved handicapped personal identification.
No vehicle, bicycle or motorized bicycle shall be utilized for commercial loading or unloading except in loading zones; provided, however, that such loading or unloading may be performed in any area designated for vehicle parking between the hours of 6:00 a.m. and 8:00 a.m. of any day.
Any vehicle, while being utilized for emptying receptacles by an authorized representative of the owner of the Washington Town Center, and any federal, state, county or municipal emergency vehicle or United States Postal Service vehicle, while such vehicle is being utilized in the discharge of official duties, shall be exempt from the provisions of this article. In addition, in circumstances involving nonrecurring emergencies, the Police Department shall have the authority to exempt any vehicle from the provisions of this article. The Township Council shall be provided with monthly reports of all emergency exemptions authorized by the Police Department.
Vehicles, bicycles, motorized bicycles, roller blades, roller skates, scooters and skateboards shall adhere to the following traffic regulations within the Washington Town Center:
A. 
Stop at intersections and crosswalks as shall be designated on the Washington Town Center Map and marked with signs and pavement markings giving notice thereof as shown on said map.
B. 
Yield to pedestrians crossing the travel lanes within a marked crosswalk or, in the absence of a crosswalk, within my unmarked crosswalk at any intersection. Whenever a vehicle is stopped to permit a pedestrian to cross the roadway or travel lanes, the driver of any other vehicle approaching from the rear shall not overtake and pass such stopped vehicle.
C. 
Proceed in the direction of traffic lanes between parking stalls with pavement markings giving notice of said direction as shown on the Washington Town Center Map.
D. 
Pause and observe traffic before exiting from traffic lanes between parking stalls and entering the travel lanes.
E. 
All delivery vehicles with a gross vehicle weight of 7,000 pounds or more shall enter the Washington Town Center via northbound Pascack Road at the south entrance located north of Pine Lake Drive. These delivery vehicles will then proceed eastbound passing the south end of the building, and then proceed northbound to the rear or east side of the building.
F. 
All delivery vehicles with a gross vehicle weight of 7,000 pounds or more shall exit the Washington Town Center via the north exit to Pascack Road, located south of Westgate Road.
G. 
The operation of vehicles, bicycles, motorized bicycles, roller blades, roller skates, scooters and skateboards on sidewalks in the Washington Town Center is prohibited.
H. 
All vehicles must proceed from the west to the east in the northernmost traffic aisle of the south parking lot, located south of the main entrance or Driveway B. All vehicles traveling in the travel lanes located west of the west side of the building are prohibited from turning into this aisle that has been designated as one-way, with travel from the west to the east.
I. 
All vehicles must proceed from the west to the east in the southernmost traffic aisle of the south lot located adjacent to the south entrance, or Driveway A, to the Washington Town Center.
J. 
As per the request of the owner of the Washington Town Center, an application has been made to the Township Council to have the provisions of Subtitles 1 and 2 of Title 39 of the New Jersey Revised Statutes governing motor vehicles applied to the travel lanes, parking aisles and roadways within the Washington Town Center. By resolution dated February 2, 1998, the Township Council has granted said request, and upon approval by the Commissioner of Transportation, all traffic on the Washington Town Center premises will be governed by the motor vehicle and traffic laws of Title 39 of the New Jersey Revised Statutes.
A. 
Installation. All signs and bicycle racks shall be procured, installed and maintained as provided in the agreement between the Township of Washington and the owner of the Washington Town Center executed in both May 1983 and December of 2000, which agreement is hereby approved and ratified, and the Mayor and Township Council are hereby authorized to execute said agreement on behalf of the Township of Washington, after which time a copy shall remain on file with the Township Clerk. The cost of installation and maintenance of pavement markings shall be borne by the owner of the Washington Town Center. The owner of the Washington Town Center shall, subsequent to initial procurement and installation, maintain such signs, pavement markings and racks in accordance with the aforesaid agreement and the provisions of this article. The owner shall repair, restore or replace any sign, pavement marking or rack within 30 days after receipt of written notice from the Chief of Police to do so, which notice shall be sent by certified mail to the address of the owner as shown on the Township tax records.
B. 
Specifications. All signs and pavement markings required by this article, and the installation thereof, shall conform to specifications established by law for signs and markings for like regulations of traffic on public highways, including the MUTCD. If there be no such specifications for any particular sign or pavement marking, and in the case of bicycle racks, the same shall conform to specifications established by the Director of Public Safety, and the specifications so established shall, as nearly as practicable, be patterned after specifications for signs and markings for similar traffic regulations on the public highways. Such specifications prescribed by the Director of Public Safety shall be furnished to the owner of the Washington Town Center, who shall comply with the requirements under this article within 45 days of receipt thereof.
C. 
Modification. The design and location of signs and pavement markings required under this article may be modified according to the following procedure:
(1) 
The Township Council shall have full authority to modify the design and location of signs and pavement markings by resolution duly adopted and served upon the Washington Town Center owner.
(2) 
A resolution under this section shall provide that the Township of Washington shall effect such modifications at its expense, except as may otherwise be provided by agreement between the Township of Washington and the Washington Town Center owner.
(3) 
A resolution under this section shall be served upon the Washington Town Center owner, who shall maintain all signs and pavement markings effected hereunder in accordance with the agreement between the Township of Washington and the Washington Town Center owner.
(4) 
The Township Engineer shall amend the Washington Town Center Map in accordance with any resolution under this section. All modifications under this section shall become effective as of the date of amendment of the Washington Town Center Map or the date of service of the resolution on the Washington Town Center owner, whichever is later.
A. 
Entrances only. No vehicle shall exit through the following driveways, which are designated as entrances only, as indicated on the attached Plan No. 1, which is incorporated herein and made a part hereof:
(1) 
Driveway A: south entrance, north of Pine Lake Drive.
(2) 
Driveway B: main entrance at the intersection of Pascack Road and Manhattan Avenue.
B. 
Exits only. No vehicle shall enter through the following driveways, which are designated as exits only, as indicated on the attached Plan No. 1, which is incorporated herein and made a part hereof:
(1) 
Driveway C: main exit at the intersection of Pascack Road and Manhattan Avenue.
(2) 
Driveway D: north exit, south of Westgate Road.
C. 
Left-turn prohibitions. No vehicle shall make a left turn at any of the following locations, as indicated on the attached Plan No. 1, which is incorporated herein and made a part hereof:
(1) 
From the westernmost traffic aisle in the parking lot to the southernmost traffic aisle in the south parking lot.
(2) 
From the northbound travel lane in the south parking lot to the northernmost traffic aisle in the south parking lot.
(3) 
From the north exit, or Driveway D, to southbound Pascack Road.
(4) 
From southbound Pascack Road into the north exit or Driveway D.
(5) 
From southbound Pascack Road into the south entrance or Driveway A.
D. 
Right-turn prohibitions. No person shall make a right turn at any of the following locations, as indicated on the attached Plan No. 1, which is incorporated herein and made a part hereof:
(1) 
North on Pascack Road into the north exit — Driveway D.
(2) 
From the southbound travel lane into the northernmost traffic aisle in the south parking lot.
(3) 
From the southbound travel lane into the southernmost traffic aisle in the south parking lot.
E. 
Lane use reservations. All vehicles shall move as provided below and as indicated on the attached Plan No. 1, which is incorporated herein and made a part hereof:
(1) 
Driveway C: right lane for right turn only.
(2) 
Driveway C: left lane for left turns and straight-ahead movements.
(3) 
Driveway B: right lane for right turns only.
(4) 
Driveway B: left lane for left turns only.
(5) 
Northernmost traffic aisle in the south parking lot: traffic travels one way from the west to the east.
(6) 
Southernmost traffic aisle in the south parking lot: traffic travels one way from the west to the east.
F. 
Do-not-enter areas. No vehicle shall enter the following locations, as indicated on the attached Plan No. 1, which is incorporated herein and made a part hereof:
(1) 
The eastern end of the southernmost traffic aisle in the south parking lot at the travel lane.
(2) 
The eastern end of the northernmost traffic aisle in the south parking lot at the travel lane.
(3) 
The western end of the southernmost traffic aisle in the south parking lot at the southern end of the westernmost traffic aisle.
A. 
Unless another penalty is expressly provided by New Jersey Revised Statutes, every person convicted of a violation of § 223-48 of this article shall be liable to a penalty of not more than $100 or imprisonment for a tern not exceeding 10 days, or both.
B. 
Any person who shall violate any provision of this article other than § 223-45 or § 223-48 shall, upon conviction thereof, be punished by a fine not exceeding $500 or by imprisonment for a term not exceeding 90 days, or both, for each offense. Each day that the violation shall continue shall constitute a separate offense.
C. 
Any person who shall park or stand in a zone designated as a fire zone, as referenced in § 223-45B of this article shall, upon conviction thereof, be punished by fines as follows:
(1) 
For passenger motor vehicles: $78.
(2) 
For commercial motor vehicles: $153.
D. 
Any person who shall park or stand in a prohibited zone, other than a fire zone, or park or stand in any area other than a marked parking stall, as mentioned in § 223-45A of this article shall, upon conviction thereof, be punished by a fine of not more than $100 or imprisonment of 10 days or both.
