[Adopted 12-4-2003 by Ord. No. 03-12]
Except when necessary to avoid conflict with other traffic or to protect the safety of any person or vehicle, or in compliance with law or the direction of a police officer or official traffic control device, the following prohibitions shall be in effect:
A. 
Stopping, standing or parking of a vehicle is expressly prohibited under the following circumstances:
(1) 
On the roadway side of any vehicle stopped, or parked at the edge or curb of the street.
(2) 
On any sidewalk.
(3) 
Within any intersection.
(4) 
On any crosswalk.
(5) 
Between a safety zone and the adjacent curb within 30 feet of points on the curb immediately opposite the ends of a safety zone.
(6) 
Alongside or opposite any street excavation or obstruction which obstructs traffic.
(7) 
Upon any bridge or other elevated structure.
(8) 
On any railroad tracks.
(9) 
On public or private property which is expressly reserved for handicapped persons or disabled veterans when said property has been posted in accordance with the regulations of the Pennsylvania Department of Transportation.
(10) 
At anyplace where official signs prohibit same.
B. 
Standing and parking of vehicles is expressly prohibited under the following circumstances:
(1) 
In front of a public or private driveway.
(2) 
Within 15 feet of a fire hydrant.
(3) 
Within 20 feet of a crosswalk at an intersection.
(4) 
Within 30 feet of any flashing signal, stop sign, yield sign or traffic control signal located at the side of a roadway.
(5) 
Within 20 feet of the driveway entrance to any fire station or, when properly posted, on the side of a street opposite the entrance to any fire station within 75 feet of the entrance.
(6) 
Any place where official signs prohibit same.
A. 
No person shall park or leave unattended a vehicle on private property without the consent of the owner or other person in control or possession of the property; except in the case of an emergency or disablement of the vehicle, in which case the operator shall arrange for the removal of the vehicle as soon as possible.
B. 
The provisions of Subsection A of § 184-2 shall not apply to private parking lots unless such lots are posted to notify the public of any parking restrictions, in which case the operator of a vehicle should not violate said posted restrictions. For the purpose of this section, "private parking lot" means a parking lot open to the public and used for parking with or without charge.
A. 
No commercial equipment, including, but not limited to, trucks, tandems (in excess of one-ton capacity), tractor-trailers, tractors or other commercial construction or cargo-moving vehicles or equipment shall be parked upon a highway or street within the Township of West Brandywine. Furthermore, no commercial equipment as described in this subsection shall be parked or stored upon a highway or street in the Township of West Brandywine after completion of the working day.
B. 
Exceptions. The following are exceptions to the restrictions set forth in Subsection A of § 184-3:
(1) 
Any commercial equipment described in this section may legally park for the purpose of delivering goods or rendering services during the normal course of business, provided that such vehicle does not substantially impede the flow of vehicular traffic.
(2) 
Vehicles being used for the purpose of road construction shall be permitted to park, stand or stop on any highway or street within the Township of West Brandywine when construction is in progress upon said highway or street.
A. 
Following the effective date of this article, it shall be unlawful to park, or allow to be parked, any motor vehicles or other vehicle on any street or road which is part of the Township system, two hours after the start of any continuous snowfall and until the snow has been completely plowed for a full width of the cartway.
B. 
Any member of the West Brandywine Township Police Department, or other employee of the Township of West Brandywine who is engaged in road work, is hereby authorized to remove, or have removed, any vehicle abandoned or parked upon any public street or highway or roadway which is part of the Township system which is in violation of the terms and provisions of this section, and to take, or have taken, any such vehicles to a nearby garage or other place of safety. The registered owner of any such vehicle shall be promptly notified of the fact of the removal and the place to which said vehicle has been removed, where he or she may obtain same upon payment of any and all towing and storage charges.

A. 
Violations of §§ 184-1A(1) through (8) and (10) and 184-2. Any persons violating any provisions of §§ 184-1A(1) through (8) and (10) and 184-2 of this article shall be guilty of a summary offense and, upon conviction before a District Justice within the magisterial district of which the Township of West Brandywine is part, shall be fined no less than $30 but no more than $50, plus court costs of prosecution. A person in violation of § 184-1A(9), regarding parking in a handicapped parking space without valid handicapped placard or registration, shall pay a fine of $50, plus court costs of prosecution.
B. 
Violations of §§ 184-3 and 184-4. Any persons violating the provisions of §§ 184-3 and 184-4 of this article shall be guilty of a summary offense and, upon conviction before a District Justice within the magisterial district of which the Township of West Brandywine is part, shall be fined no less than $40 but not more than $50, plus court costs of prosecution.
C. 
Reduced penalty. In all cases where a police officer or parking enforcement agent of West Brandywine Township first gives notice to a person of any violation of this article, either by personal service to the offending operator or by affixing to the vehicle in violation a ticket noting the date, time and location of the offense, nature of the offense charged and the license registration of the vehicle in violation, prosecution shall not be instituted for five days thereafter. If during said five-day period the offending operator voluntarily appears at the office of the Township Police Secretary during regular business hours, voluntarily enters a plea of guilty and pays a fine of $25 for violating a provision of § 184-1A(1) through (8) or (10) or 184-2 or a fine of $35 for violating any provision of § 184-3 or 184-4, no additional prosecution for said offense shall be brought. In the alternative, said offender may forward to the office of the Township Police Secretary by regular mail the appropriate fine, and no prosecution for the offense shall thereafter be brought so long as the envelope is postmarked within five days of the violation. The fines under the reduced penalty do not incur any court costs of prosecution. Any person who violates § 184-1A(9), regarding handicapped parking, shall not have a reduced penalty for this section. However, if the person pays the fine within five days by mail or in person at the township building, no additional prosecution shall be brought and no additional court cost shall be incurred.
