It shall be unlawful for any person, whether
as principal or agent, clerk or employee either for said person or
any other person or for any body corporate or as an officer of any
corporation otherwise, to:
A. Engage in the operation of one or more machines or
devices offered for public use which, upon insertion of a coin, coins
or token or by other means, dispenses unit servings of food or beverages,
either in bulk or package, without the necessity of replenishing the
devices between each vending operation, without first having applied
to and procured a permit from the Township Health Officer and displaying
the permit in a prominent location and without complying with any
and all of the provisions of Chapter XII of the State Sanitary Code
(1983), as adopted or amended by the Township Council.
B. Maintain or permit to be maintained on or in any location
in this township one or more machines or devices offered for public
use which, upon insertion of a coin, coins or token or by other means,
dispenses unit servings of food or beverages, either in bulk or package,
without the necessity of replenishing the devices between each vending
operation, without first having applied to and procured a license
for each such machine or device from the Township Division of Health
and displaying the permit in a prominent location or without complying
with any and all of the provisions of Chapter XII of the State Sanitary
Code (1983), as adopted or amended by the Township Council.
As used in this article, the following terms
shall have the meanings indicated:
COIN-OPERATED VENDING MACHINE
Any device offered for public use which, upon insertion of
a coin, coins or token or other means, dispenses unit servings of
food or beverage, either in bulk or package, without the necessity
of replenishing the devices between each vending operation.
PREMISES
The land and building and contiguous lands and buildings
comprising the entire establishment of the owner or lessee thereof
on which the coin-operated vending machine is located.
Application for and issuance of the licenses referred to in §
183-1 shall be made in conformity with the provisions of Chapter XII of the State Sanitary Code (1983), as adopted or amended by the township. Such licenses are not transferable.
Licenses issued under authority of this article
may be suspended, revoked or reinstated by the township pursuant to
the provisions of Chapter XII of the State Sanitary Code (1983), as
adopted or amended.
The Division of Health shall supervise and arrange
such inspections of coin-operated vending machines and maintain such
records as are required by N.J.A.C. 8:24-1 et seq. and Chapter XII
of State Sanitary Code (1983).
No provision of this article shall be applied
so as to impose any unlawful burden on either interstate commerce
or any activity of the state or federal government.
Penalties for violation of this article shall be as provided in Chapter
1, General Provisions, Article
II, Penalty, §
1-4.
