A. 
Boundaries.
(1) 
The boundaries of the North Haven Harbor Management Area include waters within and bounding the Village limits as shown on the North Haven Waterways Chart.[1]

(2) 
The waters bounding the Village limits are:
(a) 
Shelter Island Sound to the east and north.
(b) 
Noyack Bay to the west.
(c) 
Sag Harbor Cove to the south.
(3) 
The offshore jurisdiction limits are shown on the North Haven Village Waterways Chart and are as follows:
(a) 
From mean low tide at the west end of the North Haven Bridge to the western boundary of the Sag Harbor Main Channel; north along this boundary to a point 1,500 feet from the North Haven shoreline (MLW);
(b) 
Continuing along a line 1,500 feet from the shoreline (MLW) into Shelter Island Sound (north) and into Noyack Bay (west) to the bayward extension of the North Haven Village/Southampton Township boundary; south along this boundary to the Sag Harbor Cove shoreline (MLW);
(c) 
Southerly along a line midway between the North Haven and Bay Point shorelines to a point 250 feet out from the North Haven shoreline into Sag Harbor Cove;
(d) 
Along this line to the northern boundary of the Sag Harbor Cove Main Channel, returning to the west end of the North Haven Bridge (start point).
(4) 
The waters within the Village of North Haven included are:
(a) 
Great Pond Creek.
(b) 
Fresh Pond.
(c) 
Johnson's Creek.
(d) 
Genet Creek.
(e) 
Polles Creek.
(f) 
Ryders Pond.
B. 
Designated areas.
(1) 
Mooring areas. All mooring areas are defined as including the waters from 250 feet offshore (MLW), extending to the limits of North Haven Village bounding waters (1,500 feet or as shown). The start and end boundaries of each mooring area are:
(a) 
Harbor mooring area.

Start boundary: a line from the northeast bounds of New York State property at the Sag Harbor/North Haven Bridge extending northerly.
[2] 
End boundary: a line from the northeast bounds of Southampton Town Property at Great Pond extending easterly.
(b) 
East mooring area.
[1] 
Start boundary: a line 285 feet south of the southeast bounds of Lot 80 on the Filed Map 1531 of North Haven Manor extending easterly.
[2] 
End boundary: a line from the northeast bounds of Lot 11 on the Filed Map 1531 of North Haven Manor extending easterly.
(c) 
West mooring area.

Start boundary: a line from the northwest bounds of Lot 1 on the Filed Map 8158 of West Banks extending westerly.
[2] 
End boundary: a line from the southwest bounds of Lot 9 on the Filed Map 8158 of West Banks extending westerly.
(2) 
Fairways.
(a) 
The ferry fairway is defined as including the waters from 250 feet offshore extending to the limits of North Haven Village bounding waters (1,500 feet or as shown). The start and end boundaries of the ferry fairway are:

Start boundary: a line from Tyndall Point extending northeasterly.
[2] 
End boundary: a line from Gleason Point extending northwesterly.
(b) 
The Genet Creek Fairway is defined as the bounds of the creek connecting out to the ferry fairway by the channel as shown on the waterways map.
(c) 
The Cove Fairway starts southerly along a line midway between the North Haven and Bay Point shorelines to a point 250 feet out from the North Haven shoreline into Sag Harbor Cove. Along this line to the northern boundary of the Sag Harbor Cove Main Channel, returning to the west end of the North Haven Bridge.

A. 
Dangerous operation prohibited. No person shall operate a vessel at a speed greater than is reasonable or prudent, including, by way of illustration, not limitation, the throwing of its wake:
(1) 
So as to endanger the life or limb of another person using the harbor under the then existing conditions and having regard to the actual and potential hazards then existing; or
(2) 
So as to disturb the reasonable comfort or endanger the safety of a person on or operating another vessel or cause damage to another vessel, structure, shoreline property or the environment or interfere with the free and proper use of the waters of any channel.
B. 
Speed of vessels.
(1) 
The Village Board of Trustees may, from time to time, by local law, establish maximum speed limits for any portion or portions of water or waterways subject to this chapter and provide for the posting of speed markers.
(2) 
No person shall operate a vessel at speeds greater than five miles per hour within 500 feet of the shoreline or within the areas indicated as channels, buffers, fairways, restricted anchorages or designated mooring areas. This will not apply to the normal operation of the South Ferry service as it currently exists.
(3) 
No person shall operate a vessel in any area where there is congestion of vessels, either underway or at anchor, at a speed in excess of five miles per hour.
(4) 
The Village Board of Trustees may, from time to time, by local law, and for periods stated in such local law, suspend the enforcement of this section with respect to any portion or portions of water or waterways and designate such areas by the location of appropriate speed markers.
C. 
Identification. Vessel operators shall, at all times, identify themselves and produce the vessel's registration to Village, state or federal law enforcement authorities upon request. Failure to produce such registration upon request shall be presumptive evidence of a violation of this section.
D. 
Required equipment. No persons shall operate a vessel which does not meet all duly adopted and published requirements of the Navigation Law with regard to safety equipment to be carried on or incorporated into vessels of its type.
No person shall take off or land any aircraft within the harbor management area of the Village of North Haven. Aircraft operating on the waterway surface will be considered a vessel.
A. 
No person shall skin dive with any type of diving equipment within any channel, nor shall any person bathe or swim in any channel designated on the chart, except in the course of a rescue or similar emergency.[1]

B. 
No person shall skin dive or use self-contained underwater breathing apparatus (SCUBA) in the harbor management area unless a regulation red diving flag is displayed in accordance with the Navigation Law, nor shall any person allow or permit such diving flag to remain in any area unless a person is actually skin diving in the area while such flag is displayed.
C. 
No person shall operate a vessel within 50 feet of any area marked for skin diving by the placement of a regulation red diving flag.
No person shall discharge any apparatus designed for use in spearfishing within 250 feet of any lifelines or bathing float, nor within 250 feet of any public or other beach regularly used for bathing or swimming nor within 50 feet of any person bathing or swimming.
No person on or operating a vessel shall dump or allow the release of either the contents of any marine toilet or any refuse or any garbage in any waterway.
Nothing herein contained shall prohibit the Village Board of Trustees from issuing special permits for aquatic events or vessel races under proper supervision in limited areas and for limited periods of time.
