It is understood that there is no obligation, legal or otherwise, on the part of the Mayor and the Trustees of the Village of North Haven to accept roads or streets into the Village highway system by compliance with these specifications.
A letter requesting the consideration of the acceptance of a highway, together with a preliminary plan, shall be submitted to the Planning Board, if any. The Planning Board shall review and determine whether the preliminary plan meets the general requirements hereinafter enumerated. If a favorable report is rendered, the offer of dedication and deed, together with an abstract of title and the final plan, shall be submitted to the Village Trustees. After the Village Attorney has approved the offer of dedication and deed and the Superintendent of Public Works and the Village Engineer have approved the construction as completed in accordance with the specifications hereinafter enumerated, the Village Board may make an order laying out said highway or streets, and such order, together with the deeds, shall be filed and recorded in the office of the Village Clerk. Nothing herein contained shall prohibit the submission of an offer of dedication and deed, together with an abstract of title and final plan in lieu of requesting the consideration of the Village Board of the preliminary plan.
The person or persons submitting the offer for the dedication of land for highway purposes shall secure the necessary signatures of the owners and the mortgages, deeds, etc. The acknowledgment of all persons executing the same shall be in the same manner as a deed to be recorded in Suffolk County, New York.
A. 
The lines of the highways shall conform to the continuation of the projection of existing streets or shall conform to the layout of the existing highway system.
B. 
All highways and streets shall be at least 50 feet wide between property lines.
C. 
Dead-end highways shall be provided with a turnaround with a minimum radius equal to the width of the street.
D. 
All highways which terminate at water shall have a minimum width of 75 feet for a distance not less than 100 feet from the water.
E. 
Where necessary for proper drainage of a highway, a right-of-way or easement for a storm sewer to a pond or bay or existing storm sewer shall be granted to the Village. Whenever it becomes necessary to construct a drainage area outside of the highway lines, such area must be conveyed to the Village with necessary easements thereto. Whenever a proposed highway or street drains onto or into an existing highway or street, interceptor basins, drop outlets or leaching basins of adequate capacities shall be provided to intercept drainage before reaching the existing highway or street.
F. 
Plans for a drainage system on a proposed highway or street to be dedicated shall be submitted by an engineer.
G. 
Where a highway has been constructed so that the elevation of the highway is higher or lower than the elevation of the adjacent property, a cut or fill easement shall be granted so that a one on two slope may be maintained.
H. 
All highway intersections shall have radius curves with a minimum tangent of 25 feet.
I. 
No curve greater than a curve of 20° shall be used for horizontal alignment.
J. 
Street intersections, point of curvature and point of tangency and all angle points shall be monumented. Such monuments shall be of stone or concrete at least two feet six inches long and four inches square, and so placed so that at least four inches thereof shall appear above ground, except that where a concrete sidewalk grade is already established, the monument shall set flush to sidewalk grade.
A. 
Any survey map for filing shall be upon linen tracing cloth of a size 18 inches by 20 inches or 20 inches by 36 inches and shall be drawn to such scale as will clearly indicate all courses and curves, and in no case shall any scale more than 100 feet to the inch be used without special permission of the Village Board, which permission shall be indicated in writing upon such map and signed by a majority of the Village Board.
B. 
Maps shall be certified to be correct by a licensed surveyor and shall be dated and shall indicate the North point of the compass with relation to the survey and when describing new work shall indicate private property lines at the point of their intersection with the bounds of the survey and shall have set forth the area of each parcel of land included within the bounds of the survey, together with the name of the owner or owners, and shall be endorsed for approval by the Village to the Planning Board, if any.
C. 
Each map shall show all details, and, whenever possible, the points of beginning shall be fixed with relation to a street intersection or a highway monument at an angle point in a recorded highway. If no permanent point is reasonably to be found, monuments must be definitely placed on at least three points before the filing of said map and be shown thereon. Each map shall also show a center-line profile of existing grades and proposed grades at a scale of horizontal one inch to 50 feet and vertical grade one inch to 10 feet for each road or street to be dedicated.
D. 
Two maps on linen cloth, exact copies of the original, must be furnished, to remain the property of the Village.
E. 
Each map upon filing shall be dated that day and given a number by the Village Clerk, marked thereon and entered at once in an index of maps to be kept in the office of the Village Clerk.
F. 
Maps shall not be taken from the Village Clerk's office, except by virtue of a subpoena. Original maps are available for public inspection at the Office of the Village Clerk. No marks of any kind shall be placed upon any filed map other than the number given by the Village Clerk and the date of filing.
All orders laying out, widening or altering highways must be accompanied by all necessary deeds. The release of the mortgages of any lands affected by the proposed highway or the proposed widening or altering must be obtained.
Any of the foregoing regulations affecting highways shall include portions thereof and sidewalks.
A. 
All deeds and offers of dedication must be typewritten or printed upon paper eight inches by 13 inches and must be acknowledged by all persons executing same in the same manner as a deed to be recorded in Suffolk County, New York. Deeds executed outside of the County of Suffolk must have the certificate of the County Clerk, where any acknowledgment is taken, affixed thereto.
B. 
All deeds shall describe the land thereby released by courses and distances. Deeds and orders shall refer to the map and the file number thereof.
Orders for a survey in connection with the laying out, widening or altering of a street or a highway shall be issued by the Village Board or a duly authorized Village official with approval of said order by the Village Board. The orders shall be numbered consecutively and be made out in triplicate. A copy shall be delivered to the surveyor. The duplicate copy shall be filed with the Village Clerk and the triplicate copy with the Superintendent of Public Works or the Village Engineer, if any.
Street names designated by the applicant are subject to approval by the Village Board.
Highways or streets that enter into or terminate on a private right-of-way, regardless of width, shall be considered dead-end streets.
A. 
All proposals shall be in conformity with any Zoning Ordinance[1] that may be in effect at the time of the proposed application. The size of lots and land uses and other factors shall be governed by any Zoning Ordinance in effect at the time of the adoption of this ordinance pertaining to the area under consideration.

B. 
The person or persons making application for dedication will be required to complete the construction in accordance with the construction specifications hereinafter set forth.[2] When construction has been completed, the Village Board or Superintendent of Public Works or Village Engineer shall inspect the work and submit its or his approval to the Village Board. The Village Board may require that the applicant furnish to the Village Board a written certificate by a licensed professional engineer of the State of New York that the specifications have been met.

A surety bond or certified check in an amount and for a period to be determined by the Village Board shall be filed with the Village Clerk. Said bond shall be conditioned upon the above requirements and conditioned further upon the payment cost of improvements upon completion of the work and after approval of the Village Board. Application for the release of the check or bond should be made to the Village Board.
All trees, shrubs, bushes, roots and other vegetable matter shall be removed from the road section and the sidewalk area to the property lines. All excavations made for their removal shall be backfilled, puddled and rolled or tamped.
The road section shall be graded and rolled, with a five-to-ten-ton roller, to a uniform surface to the grade, as shown on the final plan. When the subgrade is sandy, due to the grading or other causes, or the subgrade is not of a material suitable for a base for pavement, the sand or other material shall be removed to a depth of eight inches below finished grade and a suitable loam or other subgrade material, approved by the Village Board, shall be placed therein, rolled and compacted. All cuts and fills shall meet abutting road surfaces with a one-on-two-slope.
Whenever necessary, drop inlets, leaching basins or storm sewers shall be placed to intercept drainage runoff. Wherever necessary, provision must be made for right-of-way or easement to a river, pond or bay or recharging basin. Wherever it becomes necessary to construct a drainage area outside of the highway lines, such area must be conveyed to the Village with the necessary easements thereto. Such drainage area or recharging basin shall be enclosed by a six-foot-high link wire fence.
A. 
After the roadbed has been properly prepared, an application of 3/4 gallon of MC 1 or SC 1 (bituminous cutback asphalt) or approved road oil per square yard shall be applied to a width of no less than 30 feet. After the oiling, a blotter coat of screened sand sufficient to absorb the oil shall be applied. Within 60 days after the first application, the road section shall be honed and reshaped and properly prepared to receive a second application of 1/2 gallon per yard of MC 2 and a blotter coat of sand immediately applied. Within one year after the second coat, the surface shall be honed and properly prepared to receive a third application of 1/2 gallon per square yard of RC 2 or emulsion and covered with grits or blue stone. Stone size shall be no greater than that which will pass through a three-eighths-inch square mesh sieve. Immediately after this stone or grits has been spread, a five-to-ten-ton tandem roller shall be used to roll the stone or grits. Any section that shows excess movement after raising of the roller shall be removed and properly repaired. All subgrades must be properly watered prior to each application of surface material. All excess grits or stone shall be removed within a period of 15 days.
B. 
Wherever any other material is used to construct a road section, detailed plans and specifications must be submitted to the Village Board for approval. The first coat of oil shall be applied within six months of the date of acceptance of the bond by the Village Board.
A. 
Wherever necessary for drainage or for any other reason, curbs and gutters shall be built of concrete or other approved material. Detailed plans shall be furnished to the Village Board. All specifications concerning concrete for structures or other purposes are to conform to the specifications outlined by the Department of Public Works of New York State.
B. 
Wherever necessary, valley gutters at least 24 inches in width and six inches in depth at the center, of concrete or other suitable material, shall be constructed. Specifications for such gutters shall conform to the specifications outlined by the Department of Public Works of the State of New York.
C. 
Where no curb or gutter has been specified, provisions for a shoulder six feet wide of suitable fill adjacent to the oiled section on both sides of the proposed road shall be constructed.
All necessary street signs and names of streets shall be placed at intersections and where otherwise designated by the Village Board. The Village Board shall approve the type and location of signs.
Wherever necessary, sidewalks of concrete or asphalt shall be constructed in accordance with the specifications established by the Department of Public Works of the State of New York.
