It is the purpose of this chapter to provide
for a fair and equitable process for selecting elective officers of
the Village of Morrisville in the event the general or special election
held for such purpose shall end in a tie.
In the event that more eligible persons than
the number remaining to be elected receive for the same office or
offices an equal number of votes at any general or special election
of the Village of Morrisville, the Board of Trustees shall, within
20 days of such general election, convene for the purpose of scheduling
a runoff election between such persons receiving an equal number of
votes. Such special election shall be held as soon as practicable
and shall be noticed, and conducted in accordance with the requirements
for a special election of the Village.
If each person who shall have received such
equal number of votes shall file with the Village Clerk, no later
than two days after the final certification of such tie result, a
written notice of consent that the selection of the person to be elected
shall be made by lot, the runoff election shall be deemed waived and
the Board of Trustees shall oversee the selection of the winner by
lot in accordance with the provisions of § 15-126 of the
Election Law.
