Effective November 1, 1995, the borough hereby assesses a charge or
fee in the amount of one hundred dollars ($100.) per month for each and every
public telephone which is located outdoors, on or over hanging public property
or public rights-of-way within the Borough of Wilkinsburg. Said charge or
fee is being assessed for the use of the public property or public rights-of-way
and is further being assessed in order to defray the costs of the borough
in fighting drug-related criminal activity resulting from the use of such
outdoor telephones for illegal purposes.
Said charge or fee in the amount of one hundred dollars ($100.) per
month shall be assessed against and paid by either the owner of the building
to which the telephone is attached, the owner of the business premises to
which the telephone is attached, or the company which is designated on the
telephone itself as the owner, manufacturer, supplier or distributor of the
telephone in question.
Upon default in the payment of said monthly charge or fee for a period
of more than thirty (30) days, the borough shall send a notice of default
to any or all of the above-described persons; and, if the default is not cured
by the payment in full of all delinquent monthly charges or fees, within a
period of ten (10) days of the date of the notice of default, the borough
shall order the immediate removal of the telephone in question.
Any person, persons, company, organization, corporation or other entity
who shall violate any provision of this chapter shall, upon conviction, be
subject to a fine not exceeding six hundred dollars ($600.), and costs of
prosecution, and in default of payment thereof, shall be subject to imprisonment
for a period not to exceed thirty (30) days. Each violation of any provision
of this chapter shall constitute a separate offense, and shall be punishable
as such.
