Borough of Branchville Sewer Utility.
There is hereby established in the Borough a public sewer utility to
be designated as the "Borough of Branchville Sewer Utility."
The sewer system shall be operated by the Borough as a municipal public utility to be operated pursuant to the provisions of Title 40A of the New Jersey Statutes. All fees and charges shall be established by Borough of Branchville ordinance, to be provided as set forth in §
31-5 hereof. All fees and charges received by the Borough in connection with the Sewer Utility shall be deposited in a dedicated account designated as the "Borough of Branchville Sewer Utility Fund" and used only for the purposes of such municipal utility, pursuant to N.J.S.A. 40A:4-62.
The Branchville Mayor and Council shall have complete supervision and
control over the Sewer Utility.
The standards and fees to be charged for connecting to the sanitary
sewerage collection system, in accordance with N.J.S.A. 40A:26A-11, as well
as any prohibitions or limitations in regard to use of sewer system, shall
be established in a Borough ordinance to be adopted subsequently. As required
by statute, N.J.S.A. 40A:26A-10, the Mayor and Council shall also establish
a rate structure to fix rates, rentals and other charges for use of the sewerage
services. The rate structure shall ensure sufficient revenues to allow the
Borough to recover all costs of acquisition, construction and operation of
the sewer system and to establish a surplus, as provided by the statute. Said
rate structure shall be established by ordinance to be adopted at such time
as the Borough's costs of acquisition, construction and operation have
been determined. Thereafter, Branchville shall bill sewer system users accordingly,
and collect sewer user charges.
