This chapter shall be known as "Prohibition of Parking of Commercial
Vehicles."
As used in this chapter, the following words are intended to include
and be defined as follows:
COMMERCIAL VEHICLE
Any vehicle, including a tractor which is customarily used to tow
a trailer, tractor and trailer, truck, van or trailer to a vehicle, which
exceeds 21 feet in length, regardless of its height.
PARK, PARKING and/or PARKED
The abandonment or leaving unattended of any commercial vehicle for
a period of two or more hours will be deemed to be parked in violation of
this chapter.
RIGHT-OF-WAY
Any and all property that is owned by or utilized by prescription
by the state, town, or county and is contiguous to a road shall be considered
the right-of-way.
It is deemed unlawful for any commercial vehicle, as defined in §
58-3, to be parked in any state, county or town right-of-way.
Any person or persons, association, firm, corporation or entity which
shall violate any of the provisions of this chapter shall be guilty of an
offense and shall be punishable by a fine not to exceed $150 for the first
offense, $250 for the second offense and $1,000 for the third offense or imprisonment
for not more than 15 days, or both.
This chapter shall be administered and enforced by the Police Department,
the Code Enforcement Officer and/or the Building Inspector/Municipal Zoning
Officer.
