The use of the public streets, alleys, rights-of-way
and other public property for the construction, erection, maintenance
and operation of telecommunication and electric distribution lines
and systems, including poles, wires, cables, apparatus and equipment,
whether now or hereafter erected, constructed or installed, shall
at all times be subject to regulation by the Mayor and Council.

An annual charge shall be paid to the Town of Myersville for
each and every pole now or hereafter erected upon any of the public
streets, alleys, rights-of-way or other public property in the Town
for the purpose of stringing thereon telecommunication or electric
wires or cables or as a part of any telecommunication or electrical
distribution system. There shall also be paid to the Town of Myersville
an annual charge for each and every 100 feet of wire, cable or conduit
strung or extended on or along such poles in the Town. Said charges
shall be paid by the person, firm, or entity which owns or controls
such poles, wires, cable or conduit and shall be due and payable on
or before July 1 of each year. The annual charge shall be established
annually by the Mayor and Council at the time that the annual budget
and real property tax rates are established and adopted. Until such
time as a new charge is established, the annual charge for each pole
shall be $38.88, and the annual charge for each and every 100 feet
of wire, cable or conduit shall be $38.88.
