The Mayor is hereby authorized and empowered, whenever in his judgment he shall think it necessary for the preservation of the public health and safety, to suspend, curtail, regulate and prohibit the outdoor use of any water from the Municipal Water System of the Town for the watering of streets, lawns, flowers, shrubbery, gardens, etc., for the washing of automobiles and other vehicles, the use of water for the filling of swimming pools of all kinds, other similar water usage and/or to regulate, curtail or prohibit the use of water for any purposes other than ordinary household, domestic, and culinary purposes.
The Mayor is hereby authorized and empowered to give notice of said restricted water use by regular mail to all consumers of water to curtail, regulate or refrain from the use of water for all or any of the purposes specified in this chapter. Notice of said restriction shall also be published in at least one newspaper that is circulated in the Town of Myersville.
Any landowner, tenant, or other individual in possession of real property violating the terms and conditions of any water restriction pursuant to this chapter shall be charged a prohibited water usage fee of $250, which shall be paid to the Town of Myersville no later than 35 days after receiving notice of his or her prohibited water usage; or in the alternative appear before the Town Council within 31 days subsequent receipt of said notice to present cause why the prohibited water usage fee should not be assessed.
In the event that the landowner, tenant, or other individual in possession appears before the Mayor and Council, the Mayor and Council shall be obliged to hear the individual's explanation and determine by a majority vote of the Council if said water usage is/was prohibited pursuant to this chapter. If the Mayor and Council finds that the individual did violate the restrictions, then within 10 days of the hearing the individual shall pay the prohibited water usage fee of $250, plus an additional $50.
Any landowner, tenant, or other individual in possession of real property who violates the terms and conditions of any water restriction and who fails to pay the prohibited water usage fee within the aforementioned period shall have their water service disconnected.
Any landowner, tenant or individual in possession who has had the water service disconnected to his or her property pursuant to this chapter shall not have such service reconnected until such time as the prohibited water usage fee of $250 plus an additional reconnection fee of $250 is paid to the Mayor and Council.
