This chapter is adopted pursuant to Article
II, Section 2.04(f) of the contract by and between Black Earth, Mazomanie and Arena creating and chartering a Joint Sewerage Commission pursuant to § 66.0301, Wis. Stats. ("Commission Agreement"), as may be amended, and other applicable state and federal law.
This chapter governs the use of public and private sewers and drains,
disposal of holding tank wastes into public sewers, and the discharge of waters
and wastes into the Village's local system and the regional system operated
by the Dane-Iowa Wastewater Commission ("DIWC" or "Commission"). This chapter
provides for and explains the method used for levying and collecting sewerage
and wastewater treatment service charges, sets uniform requirements for discharges
into the local system, provides for annexations and connections to the local
system and enables the Village and Commission to comply with administrative
provisions, water quality requirements, toxic and pretreatment effluent standards
and other discharge criteria which are required or authorized by the Village,
Commission, state authorities and/or federal authorities. The intent of this
chapter is to preserve and obtain the maximum public use and benefit of the
local and regional systems, to regulate the characteristics of wastewater
discharged to the local and regional systems and to otherwise protect the
health, safety and welfare of the inhabitants of the Village.
The regulations adopted by the Commission shall be binding on the Village and other contracting municipalities pursuant to Article
II, Section 2.04(f) of the Commission Agreement. The Commission Regulations shall be binding on the School District and limited contract users, except to the extent that the regulations are inconsistent with any express written agreements entered into by and between the Commission and/or the School District or a limited contract user. All territory added to the District shall be subject to and required to comply with applicable Commission Regulations.
The ordinances adopted by the contracting municipalities are to be uniform
as provided in Section 2.04(f) of the Commission Agreement.
If there is any conflict between this chapter and any applicable local,
state or federal law, rule, ordinance or regulation, the most stringent shall
control.
The Village may amend this chapter in part or in whole as it deems necessary,
provided that such amendment is done in the manner provided by the Commission
Agreement and applicable law.
