The words hereinafter defined shall have the meaning herein indicated for the purposes of this article as follows:
DOG
Any dog, bitch or spayed bitch.
HABITUALLY BARKING OR CRYING DOG
Any dog whose owner has previously been warned, in writing, by the enforcement official that his or her dog's barking, crying or other like activity has or does create a nuisance within the area of the township in which it is located and who, after such a warning, continues to bark, cry or otherwise engage in like activity.
OWNER
When applied to the proprietorship of a dog, shall mean and include every person having a right of property in such dog or every person who has such dog in his or her keeping.[1]

A. 
Habitually barking or crying. No person shall keep, harbor or maintain any dog which habitually barks or cries between the hours of 10:00 p.m. and 7:00 a.m. prevailing time.

B. 
Running at large; prohibition. No person owning, keeping or harboring any dog shall suffer or permit it to run at large upon the public streets, in any public parks or in any public place within the Township of Delanco.
C. 
Female dog in heat. A female dog in heat must be confined by its owner to the house or other shelter sufficient to prohibit access from other dogs. During this period in heat, said dog shall not be chained in an open yard or area at any time.
D. 
Leash required; streets. No person owning, keeping or harboring any dog shall suffer or permit it to be upon the public streets or in any of the public places of the Township of Delanco unless such dog is accompanied by a person over the age of 12 years and is securely confined and controlled by adequate leash not more than six feet long.
E. 
Injury to private property. No person owning, keeping or harboring a dog shall permit or suffer it to do any injury or to do any damage to any lawn, shrubbery, flowers, grounds or property.
F. 
Muzzling. The Township Committee may, by resolution, designate any time during which dogs outside the premises upon which they are kept shall be muzzled. Such designation shall be published at least three times in a newspaper in which legal notices of the township may be published, and after such publication, no person owning, keeping or harboring a dog shall permit it to be upon a public highway, public place or outside the premises in which said dog is kept, during the period designated, unless such dog wears a muzzle securely fastened over its jaws in such a manner as it cannot bite.[1]

G. 
Sanitary nuisances prohibited. An owner, harborer or keeper of a dog shall not cause, suffer, permit or allow such dog to soil, defile, defecate on or commit any nuisance on any common thoroughfare, street, sidewalk, passageway, road, bypass, play area, park or any place where people congregate or walk, or upon any private property without the permission of the owner of the private property in the last instance. If any such person shall permit such dog to soil, defile, defecate on or commit any nuisance on the aforesaid area, he or she shall immediately remove and dispose of all feces and droppings deposited by such dog, which removal shall be in a sanitary manner by a shovel, container, disposal or bag.

The Enforcement Official of this article shall be the person or company employed by the Township of Delanco under its Joint Animal Control Service Agreement, the Police Department of the Township of Delanco or the Township Committee.

Any person who shall violate any of the terms or provisions of this article, or do any act or thing therein prohibited, or neglect, fail or refuse to do any act or thing therein required to be done shall be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty.
