In the interpretation of this article, the following
words and phrases shall have the following meanings:
ASHES
The residue from fires used for cooking foods and heating buildings, with the exception as set forth in §
245-13 of this chapter, such floor sweepings as may accumulate in connection with the ordinary daily use of dwellings and stores, bottles, glass, crockery and tin cans.
GARBAGE
The meat and vegetable waste solids resulting from the handling,
preparation, cooking and consumption of foods.
LITTER
Garbage, refuse and rubbish as defined herein and all other
waste material which, if thrown or deposited as herein prohibited,
tends to create a danger to public health, safety or welfare.
PAPER
Newspapers, periodicals, cardboard and all other wastepaper.
PUBLIC PLACE
Any and all streets, lanes, parkways, sidewalks, municipal
parking lots, alleys or other public ways, and any and all public
parks, squares, spaces, recreation areas, grounds and buildings.
REFUSE
All putrescible and nonputrescible solid wastes (except body
wastes), including but not limited to garbage, rubbish, ashes, street
cleanings, dead animals, abandoned automobiles and solid market and
industrial wastes.
RUBBISH
Rags, old clothes, leather, rubber, carpets, wood, excelsior,
sawdust, tree branches, yard trimmings, wood furniture and other combustible
solids not considered by the Township to be of a highly volatile or
explosive nature, metals, metal shavings, tin cans, glass, crockery
and other similar materials, but not the wastes resulting from building
construction or alteration work. It shall also include any small accumulation
of cellar or yard dirt.
TRADE WASTE
All material resulting from the prosecution of any business,
trade or industry conducted for profit, and shall include paper, rags,
leather, rubber, cartons, boxes, wood, excelsior, sawdust, garbage
and other combustible solids except manure and not considered by the
Township to be of a highly volatile or explosive nature, metals, metal
shavings, wire, tin cans, cinders, earth and other materials, but
not the wastes resulting from building construction or alteration
work.
WASTE MATERIAL
All or any garbage, refuse, paper, ashes, no matter how originating,
wastes from building construction or alteration work or cellar or
yard dirt.
Annually, each and every person desiring to
engage in the business of privately collecting waste material within
the Township shall apply to the Township Committee for permission
to do so during the current calendar year. No such permission shall
be granted until and unless the applicant shall have satisfied the
Township Committee of the sufficiency and sanitation of the equipment
and vehicles to be used in the private collection and disposal of
such waste material.
Every private collector of waste material authorized as provided for in §
245-2 shall conform to the provisions of this chapter, other ordinances of this Township and the regulations of the Township Committee governing the collection and disposal of rubbish waste material.
All vehicles used in transporting waste material
through the streets of the Township must be furnished by the owner
with a good and tight body, and must be fully enclosed sanitary packer-type
vehicles capable of holding at least six inches of water and at least
16 cubic yards of refuse.

It shall be unlawful to discard or dump any
household or commercial solid waste in any place not specifically
designated for the purpose of solid waste storage or disposal.
It shall not be lawful for any person, excepting
an employee of the Township in the discharge of his or her duties
or an authorized waste collector, to collect, pick in, rake up or
in any way disturb the paper, garbage or other waste material of whatsoever
nature deposited in any receptacle or laid or placed anywhere within
the Township.

A. It shall be unlawful to store in areas zoned residential
any bulky household items such as appliances, furniture or mattresses,
except in a fully enclosed structure.
B. It shall be unlawful to store tires in areas zoned
residential except in a fully enclosed structure.
Township refuse collectors are prohibited from entering upon any unaccepted lands, streets, service areas, driveways or alleys or any privately owned buildings, or portion of any such building such as a vestibule, kitchen, pantry, cellar or boiler room, for the purpose of moving refuse material to the curb for collection, except as provided in §
245-18B hereof.
When trade waste, as defined in §
245-1 of this chapter, exceeds a total of three bushels in bulk or 100 pounds in weight at any one collection, such trade waste will not be collected by the Township, but the producer thereof shall, at his or her own expense, deliver or have delivered by an authorized collector, as set forth in §
245-2 of this chapter, such materials to a location as designated by regulation of the Township, as set forth in §
245-18 of this chapter.
Ashes as defined in § 243-1 of this
chapter and to be collected by the Township will not include the fuel
residue from steam power plants. Those from boilers heating buildings
will be collected by the Township, but where such boilers are also
used for lighting or power purposes, the ashes will not be collected
by the Township if those resulting from light or power generation
exceed 10% of the total ashes produced by the boilers.

A. The collection of motor vehicle tires shall be accomplished
by the completion of a form to be prepared by the Township Clerk.
A resident shall complete the form at the Municipal Building and pay
the required fee. Collections shall be made upon a designated day
at the residence of the applicant. Tires shall be placed at the curb
in front of the residence on the designated day.
B. There are hereby imposed the following fees for the
collection of discarded tires:
(1) Each car tire up to 15 inches of rim span: $2.
(2) Each tire from 16 inches to 19 inches of rim span:
$5.
(3) Each tire over 20 inches of rim span: $10.
(4) Each tire rim: $1.

No person shall prevent or interfere with any
agent or employee of the Township in the discharge of his or her duties
in the collection of garbage, ashes or refuse or in the sweeping or
cleaning of any street, or in the removal therefrom of sweepings,
ashes, garbage, rubbish, paper, snow, ice or other refuse material.
No person shall sweep into or deposit in any
gutter, street or other public place within the Township the accumulation
of litter from any building or lot or from any public or private sidewalk
or driveway. Persons owning or occupying places of business within
the Township shall keep the sidewalks in front of their business premises
free of litter.
No person, while a driver or passenger in a
vehicle, shall throw or deposit litter upon any street or other public
place within the Township.
No person shall drive or move any truck or other
vehicle within the Township unless such vehicle is so constructed
or loaded as to prevent any load or contents of litter from being
blown or deposited upon any street or other public place; nor shall
any person drive or move any vehicle or truck within the Township,
the wheels or tires of which carry out or deposit, in any street or
other public place, mud, dirt, sticky substance or foreign matter
of any kind.
No person shall throw or deposit litter, rubbish
or waste material in any fountain, pond, lake, stream, river or any
other body of water in a park or elsewhere within the Township.
No person shall throw or deposit litter, rubbish
or waste material on any occupied private property within the Township,
whether owned by such person or not, except that the owner or person
in control of private property may maintain authorized private receptacles
for collection in such a manner that litter will be prevented from
being carried or deposited by the elements upon any street, sidewalk
or other public place or upon any private property.
The owner or person in control of any private
property shall at all times maintain the premises free of litter,
rubbish or waste material; provided, however, that this section shall
not prohibit the storage of litter in authorized private receptacles
for collection.
No person shall throw or deposit litter, rubbish
or waste material on any open or vacant private property within the
Township, whether owned by such person or not; provided, however,
that this section does not apply to litter resulting from the normal
course of construction of any buildings or parts thereof during the
period of such construction.
No person shall throw or deposit litter, rubbish
or waste material in or upon any street, sidewalk or other public
place or publicly owned property within the Township.

A. Litter receptacles and their servicing are required
at the following public places which exist in the municipality, including:
sidewalks used by pedestrians in active retail commercially zoned
areas, such that at a minimum, there shall be no single linear quarter
mile without a receptacle; buildings held out for use by the public,
including schools and government buildings; parks; drive-in restaurants;
all street vendor locations; self-service refreshment areas; construction
sites; gasoline service station islands; shopping centers, parking
lots; marinas, boat moorage and fueling stations; boat launching area;
public and private piers operated for public use; beaches and bathing
area; and at special events to which the public is invited, including
sporting events, parades, carnivals, circuses and festivals. The proprietors
of these places or the sponsors of these events shall be responsible
for providing and servicing the receptacles such that adequate containerization
is available.
B. "Litter receptacle" means a container suitable for
the depositing of litter.
No person shall bring, cart, remove or collect
any litter from outside this municipality to transport into this municipality
for the purpose of dumping or disposing thereof.

Any person, firm or corporation who shall violate any of the provisions of this chapter shall, upon conviction thereof, be punishable as provided in Chapter
1, General Provisions, Article
II, General Penalty.
