All excavations or trenches hereafter required
to be made in the streets, alleys and public grounds of Dover for
the purpose of connecting with or tapping the water mains shall be
made from the water main to the curbline by the Board of Water Commissioners
and under the direction of the Street Committee of the Mayor and Board
of Aldermen and at the cost and expense of the party applying to have
such excavation or trench or trenches made, as hereinafter provided;
and such excavations, trenches and water connections shall be made
at all reasonable and proper times and places, upon notice in writing
to said Board of Water Commissioners, that the same are desired by
citizens or property holders and shall be made by said Board of Water
Commissioners at the lowest cost and charge therefor, for which the
same can be properly done; and such excavations and trenches shall
be promptly refilled and the streets, alleys and public grounds and
the macadam, cobbling and curbing restored to as perfect, level and
smooth condition as before any such trenches or excavations were so
made, provided that, before any such excavation or trench can be made
in any of the streets or public grounds of Dover as aforesaid by the
Board of Water Commissioners, there shall be deposited with said Board
of Water Commissioners, by the party so applying to have such excavation
or trench made for the purpose aforesaid, such sum as shall be sufficient
to pay the entire cost and expense of making such excavation or trench
and refilling the same and restoring the streets, alleys and public
grounds and the macadam, cobbling and curbing thereof to as perfect,
sound, level and smooth condition as before such excavations or trenches
were made therein.
Upon the completion thereof, a bill of the cost
and expense thereof shall be thereupon rendered to such citizen or
property holder as shall have made such deposit to pay for making
such excavation or trench and filling the same and restoring said
streets, alleys and public grounds to their former condition; and
all balance of such deposit remaining after paying for the cost of
making such excavation or trench and filling the same and restoring
said streets, alleys and public grounds, in which the same shall be
so made to their former condition as is hereinbefore provided, shall
be by said Board of Water Commissioners returned to the citizen or
property holder who shall have made such deposit, together with said
bill.

Any person, firm or corporation who or which
shall violate any of the provisions of this article shall be subject
to one or more of the following: a fine not exceeding $1,250, a term
of imprisonment not exceeding 90 days or a period of community service
not exceeding 90 days.
