The following regulations shall govern persons,
firms or corporations participating in construction projects to which
this article applies:
A. If the project is within 500 feet of an occupied residence,
no construction activity shall take place between the hours of 10:00
p.m. and 6:00 a.m. For purposes of this subsection, "construction
activity" is defined as any work audible at the boundary of the construction
site.
B. The person, firm or corporation obtaining a construction permit must request from the Township Manager or his designee an approved route for construction traffic. All construction equipment, including all vehicles used by workers employed in the project for transportation, must follow the route prescribed by the Township Manager or his designee pursuant to §
135-35.
C. Adequate parking for all vehicles must be provided
on the construction site, unless the Township Manager or his designee
approves designated off-site parking areas. Such off-site areas shall
be approved only where sufficient on-site space is unavailable.
The Township Manager or his or her designee
shall use the following standards when specifying an approved route:
A. For vehicles or equipment with a gross weight exceeding
four tons, the route shall:
(1) Whenever possible avoid paved or partially paved streets
which have been or are intended to be dedicated to the Township. This
limitation shall not apply to state or county highways or roads within
the same subdivision.
(2) Avoid streets containing a school or occupied residences.

Where established streets meeting the standards
in this subsection are not available, a temporary, unimproved roadway
may be required.

B. For vehicles or equipment having a gross weight of
less than four tons, the route shall:
(1) Avoid streets containing a school or occupied residences.
(2) Whenever possible be the same route used by heavy construction traffic as specified in Subsection
A. If said route is unimproved, an alternate route may be designated.
The Township Manager may waive the requirements
of this article when the size or location of the project, weather
conditions or other factors make the requirements unnecessary or unduly
burdensome.
Any person, firm or corporation, unless previously granted a waiver pursuant to §
135-36, violating any provision of this article shall, upon conviction thereof, be punishable as provided in Chapter
1, Article
I, of this Code.
