The Township of Franklin hereby establishes a reciprocal agreement with
the Borough of Clinton, State of New Jersey, for intermunicipal police assistance
at times of any and all emergencies, pursuant to N.J.S.A. 40A:14-156.1 et
seq.
The Township of Franklin shall bear all expenses incurred by members
of the Franklin Township Police Department for emergency assistance rendered
to the Borough of Clinton and shall make no claim for reimbursement on such
Borough of Clinton for damages, injuries, wages or other expenses for aid
rendered by the members of its Police Department to the Borough of Clinton,
provided that the Borough of Clinton has adopted the appropriate reciprocal
ordinance substantially in conformity with this article.
Pursuant to the provisions of N.J.S.A. 40A:14-156.2, the members of
the Police Department of the Township of Franklin, while on duty rendering
assistance outside of their respective town, shall have the same powers, authority
and immunities as have the members of the Police Department of the Borough
of Clinton.
Pursuant to the provisions of N.J.S.A. 40A:14-156.3, if any member of
the Police Department of the Township of Franklin is summoned pursuant to
this agreement and suffers injury or death in the performance of his/her duties,
he/she or his/her designee or legal representative shall be entitled to such
salary, pension rights, workers' compensation or other benefits as would have
accrued if such injury or death had occurred in the performance of duties
in the Township of Franklin.
When an emergency occurs and intermunicipal police assistance is requested
pursuant to this article and similarly enacted ordinances, the Chief of Police
of the municipality wherein said emergency exists shall be the senior ranking
officer of all members of any Police Department which may be rendering assistance
within the confines of the said municipality.
This article shall take effect immediately after final passage and publication
in accordance with the laws of the State of New Jersey, but will remain inoperative
until the adoption of a reciprocal ordinance by the Borough of Clinton providing
substantially the same terms and conditions set forth in this article.
