A person shall not cause or allow open burning unless approved in accordance with the New Jersey Uniform Fire Code. It shall be unlawful for any person or persons to burn trash, lumber, construction materials, leaves, straw, brush, trees, paper, cardboard, plastics or any other combustible materials within the established boundaries of the Township on public or private properties.
The Fire Marshal/Fire Official shall prohibit open burning within the established boundaries of the Township, except in such cases as the person or persons desiring to burn any of said materials shall apply for or have a legal and valid permit to do so.
The Bureau of Fire Prevention shall have jurisdiction in policing and issuing open burning violations.
Any person or persons who violate any of the provisions of this article shall be subject to a fine of not less than $250 or more than $500 for each such violation. Said fines shall be imposed on complaint and conviction in the Municipal Court of the Township Franklin.
