A. The City Manager shall be appointed by the City Council
for an indefinite term as provided by law. Before taking office, the
City Manager shall furnish a fidelity bond in an amount satisfactory
to the City Council, conditioned upon the faithful performance of
his duties, with a corporation licensed to do business in the State
of New Jersey as surety. Such bond shall be filed with the Clerk after
being approved by the City Council.
B. The City Manager shall be a person, other than a member
of the City Council, fully qualified to exercise the powers and perform
the duties hereinafter set forth. He need not be a resident of the
City of Garfield, nor shall he be required to become a resident of
the City of Garfield at any time during his period of service.
The City Manager shall hire and discharge all
employees (other than those under civil service or other tenure of
office laws) authorized by the City Council to be hired, at such compensation
as may be set or authorized by the City Council. All employees shall
perform their duties subject to the direction of the City Manager
or that of the superior to whom such Manager may assign such employee,
provided that such Manager may delegate to any other official or employee
the authority to hire or discharge any employees so authorized.
The City Manager shall be general purchasing
agent of the City, and except where specific provision to the contrary
is made by law or by the Council, he shall make all purchase of supplies,
materials and equipment authorized by the Council, in the manner prescribed
by and subject to the limitations imposed by law. No purchase shall
be made or obligation incurred excepting upon authorization by the
Council, and no expense shall be incurred, except for a purpose for
which no prior appropriation is required by law, if the amount thereof
is not covered by an unexpended appropriation for the purpose.
It shall be the duty of the City Manager to
keep current accounts showing at all times the fiscal condition of
the City, including the current and anticipated expenses, appropriations,
cash on hand and anticipated revenue of all municipal funds and accounts;
and he shall see to the collection of all money due the municipality.
The City Manager shall keep a current inventory
showing all real and personal property of the City and its location
and shall be responsible for the care and custody of all other City
property which is not by law assigned to some other officer or body
for care and control.
It shall be the duty of the City Manager to
see to the publication of all notices, ordinances or other documents
required by law to be published, and to prepare or cause to be prepared
all reports which the City or any of the officials thereof are required
by law to prepare.
The City Manager shall prepare for the City
Clerk all notices, ballots and election supplies necessary in connection
with municipal elections.
The City Manager shall prepare and have custody
of all municipal records required by law to be kept by the City and
not by a specific officer. Where the law makes it the duty of a specific
officer to keep or maintain records, the City Manager shall make available
to such officer all necessary clerical assistance for the preparation
of such records and shall make available a place for the custody of
such records. And in compliance herewith the City Manager shall make
available to the Clerk stenographic or clerical assistance necessary
for the preparation of the journal of Council proceedings and the
record of ordinances and all other documents which by law the Clerk
is required to keep, and he shall perform similar service for the
Treasurer in the maintenance of bond registers and all other records
or documents which by law the Treasurer is required to keep or prepare.
The City Manager shall cause to be kept a complete
set of maps and plats showing the location of all City utilities and
other municipal properties, all streets and other public places and
all lots or parcels of land subdivided according to law.
The City Manager shall maintain an office in
the City Hall and shall devote all of his time and energy to the performance
of his duties.
The City Manager shall attend all meetings of
the City Council with the right to take part in the discussions but
without the right to vote.
The City Manager shall perform such other duties
as may be required of the City Manager by ordinance or resolution
of the City Council.
The City Manager shall in all matters act under
the direction and supervision and subject to the approval of the City
Council.

The City Manager shall be paid an annual salary
in such amount as the City Council shall provide in the Annual Salary
Ordinance.
