As used in this article, the following terms
shall have the meanings indicated:
PERSON
A natural person, corporation, partnership, sole proprietorship,
estate or trust, and shall include the plural form of any entity or
person defined herein.
Before any person or persons, corporation or
corporations shall deposit materials used in the construction, raising
or altering of any building or structure or any part thereof, or to
be used for any other purpose, upon any street, road or public right-of-way
within the City of Garfield, such person or persons, corporation or
corporations shall first apply for and obtain from the City Clerk
a permit for that purpose, to be signed by said Clerk.
Before securing such permit from the City Clerk,
such person or persons shall submit a receipt signed by the City Tax
Collector, showing that the sum of $250 has been deposited in the
City treasury. This money shall remain in the hands of the Collector
and be kept by him in a separate fund until the depositor returns
with a written certificate from the Superintendent of Public Works
to the effect that all materials have been removed from the street,
road or public right-of-way and that such street, road or public right-of-way
has been left in the same condition as it was prior to the use of
said street for the purpose aforesaid.
If the person or persons securing such permit
and leaving such deposit do not clear the street, road or public right-of-way
within a reasonable time after the completion of the work undertaken
by such person or persons at that place, the Superintendent of Public
Works shall and hereby is empowered to remove such materials and to
put the street, road or public right-of-way in the same condition
as existed prior to the time that such materials were placed there.
The cost of removing such materials shall be deducted from the money
deposited with the Tax Collector.
All materials stored in the streets shall in
no case take up more than 1/3 of the width of the street as measured
between curbs. All materials so stored in the streets must be marked
by red lights at nighttime so as to warn the public of danger due
to such obstructions existing in the streets.

Any person or persons, corporation or corporations
violating any provision of this article shall be punished by one or
more of the following: a fine not exceeding $2,000; imprisonment for
a term not exceeding 90 days; and/or a period of community service
not exceeding 90 days.
