It shall be unlawful for any person or persons, corporation or corporations to tear up, excavate, remove or replace any sidewalks, curbs, gutters or any part thereof in the City of Garfield without first obtaining from the City of Garfield Building Department a permit therefor.
Said permit shall be in writing, signed by the City Clerk, and shall state as nearly as practicable where said tearing up, excavating, removal or replacement is to be done; said permit shall further contain the stipulation that it is issued with the express understanding and agreement that the applicant therefor shall pay the expenses of repairing and replacing such sidewalk, curb or gutter or part thereof.

Said work shall be done and performed under the supervision of the Superintendent of Public Works and Building Inspector of the City of Garfield.
Whenever any person or persons, corporation or corporations shall have authority under any contract with the said City or any officer thereof, that may permit the authorizing of same, to tear up, excavate, remove or replace any of the sidewalks, curbs or gutters in said City so as to obstruct and prevent the same from being used for the time being for the purpose of travel, such person or persons shall place or cause to be placed in conspicuous positions where such work is being done, at twilight in the evening, suitable and sufficient lights and keep them burning through the night during the performance of such work and the continuance of such obstruction. Any obstruction necessary for the performance of said work shall be removed as soon as the job is completed, and the work shall be finished as expeditiously as possible.

Each and every person violating any of the provisions of this article shall, upon conviction thereof, be punished by one or more of the following: a fine not exceeding $2,000; imprisonment for a term not exceeding 90 days; and/or a period of community service not exceeding 90 days.
