This chapter is enacted by the Township Committee of the Township of
Manalapan to provide rules and regulations and standards and procedures for
the construction and placement of antennas within the Township, the regulation
of which is necessary and essential to promote the public health, safety and
welfare of the community; to promote a desirable visual environment and good
civic design and arrangements; to secure safety to the public; to ensure the
orderly installation of such equipment; and to provide sufficient space in
appropriate locations for use of antennas according to recognized environmental
safety requirements.
As used in this chapter, the following terms have the meanings indicated:
ANTENNA
Any apparatus or device which is designed for the purpose of receiving
or transmitting microwave, television, radio, satellite or other energy signals
in freespace.
GROUNDING
The electrical connection to earth by means of a copper rod of a
proper diameter and a connecting wire or braid as approved by National Electric
Code (NEC). The connection of the wire or braid shall also be bonded in accordance
with NEC requirements.
SUPPORTING STRUCTURE
Any tower, tripod, pole, monopole device either guyed or self-supporting,
either fixed or movable structure used to direct, point, hold or support an
antenna. This shall include but shall not be limited to a pad or pads or piling,
or platform fabricated from concrete, wood, ferrous metal or aluminum.
The applicant shall deposit the sum of $100 with the Township Clerk
to cover the cost of review services provided by Township engineers or professionals.
The Construction Official of the Township of Manalapan is hereby designated
as the public officer charged with the enforcement of the terms of this chapter.
All complaints for alleged violation of any of the terms of this chapter shall
be submitted in writing to the Construction Official.
Where the Construction Official finds that an antenna has been constructed
and/or maintained in violation of this chapter, he may, after a ten-day notice
to remove said violation, file a complaint in Municipal Court for violation
of this chapter. Upon the finding of the Court that the antenna has been maintained
in violation of this chapter, the offense shall be punishable by a fine of
not more than $1,000 or imprisonment for not more than 90 days, or both, at
the discretion of the Court imposing same.
