This chapter is enacted by the Township Committee of the Township of Manalapan to provide rules and regulations and standards and procedures for the construction and placement of antennas within the Township, the regulation of which is necessary and essential to promote the public health, safety and welfare of the community; to promote a desirable visual environment and good civic design and arrangements; to secure safety to the public; to ensure the orderly installation of such equipment; and to provide sufficient space in appropriate locations for use of antennas according to recognized environmental safety requirements.
As used in this chapter, the following terms have the meanings indicated:
ANTENNA
Any apparatus or device which is designed for the purpose of receiving or transmitting microwave, television, radio, satellite or other energy signals in freespace.
GROUNDING
The electrical connection to earth by means of a copper rod of a proper diameter and a connecting wire or braid as approved by National Electric Code (NEC). The connection of the wire or braid shall also be bonded in accordance with NEC requirements.
SUPPORTING STRUCTURE
Any tower, tripod, pole, monopole device either guyed or self-supporting, either fixed or movable structure used to direct, point, hold or support an antenna. This shall include but shall not be limited to a pad or pads or piling, or platform fabricated from concrete, wood, ferrous metal or aluminum.
A. 
Permitted districts. Antennas shall be permitted in all commercial and business districts as an accessory use.
B. 
Any antenna mounted on the ground or structure not attached to a building shall be required to meet the following design standards:
(1) 
Maximum height shall not exceed seven feet above highest point of the major structure on the site.
(2) 
The antenna shall be designed in such a manner that it not present any overturning movement to dislodge said antenna from its mounting.
(3) 
The mounting antenna and structural configuration shall be designed and certified for safety purposes by a New Jersey licensed professional engineer.
C. 
Any antenna mounted on or attached to a building shall be required to meet the following design standards:
(1) 
Maximum height shall not exceed seven feet above highest point of the building.
(2) 
Antenna less than and including five feet above highest point of the building shall not require any application or approval.
(3) 
The antenna shall be designed in such a manner that it not present any overturning movement to dislodge said antenna from its mounting.
(4) 
The mounting antenna and structural configuration shall be designed and certified for safety purposes by a New Jersey licensed professional engineer.
A. 
Permitted districts. Antennas shall be permitted in residential districts as an accessory use, subject to the provisions of this section.
B. 
Application. Any person desiring to construct and operate an antenna shall, prior to such construction and operation, submit an application to the construction office of the Township, which shall consist of the following:
(1) 
The proposed antenna, proposed plantings and fencing or other barriers to provide protection and screening.
(2) 
The height of the proposed antenna to its highest point including supporting structure.
(3) 
One set of construction drawings sealed and approved by a New Jersey licensed professional engineer.
(4) 
The name and address of the applicant and owner of the property on which the antenna is to be located.
(5) 
The tax lot and block numbers and the property lines of the property as disclosed on the Township Tax Map.
(6) 
All existing buildings and structures and all accessory buildings and structures on the property.
(7) 
The tax lot and block numbers and the property lines of all properties as disclosed on the Township Tax Map within 200 feet from the property.
C. 
Design standards. All antennas shall fully comply with the following standards:
(1) 
An antenna shall only be located in a rear or side yard, shall not be closer to any property line than the height of the antenna and may not be located in a buffer area.
(2) 
The antenna shall not violate any yard setback requirements applicable to accessory structures within the particular zoning district.
(3) 
The antenna shall be mounted to a supporting structure in a manner to prevent its movement or dislocation due to wind, ice or other environmental event.
(4) 
The height of the antenna to its highest point and supporting structure shall not be more than seven feet above the principal building on the site.
(5) 
All wiring or connecting cables between the antenna and the principal building shall be buried underground with grounding and bonding.
(6) 
An antenna shall be so located and shall be effectively screened from view by natural plants, trees or other suitable sight barriers, which shall be maintained in good condition, in order to minimize the noise and visibility of the earth terminal from any adjacent property and/or public street.
(7) 
Only one antenna structure shall be permitted on the applicant's property.
(8) 
An antenna shall only be used by residents of the principal building on the applicant's property. Any connection, by cable or otherwise, to adjacent properties shall constitute a violation of yard and setback requirements.
The applicant shall deposit the sum of $100 with the Township Clerk to cover the cost of review services provided by Township engineers or professionals.
The Construction Official of the Township of Manalapan is hereby designated as the public officer charged with the enforcement of the terms of this chapter. All complaints for alleged violation of any of the terms of this chapter shall be submitted in writing to the Construction Official.
Where the Construction Official finds that an antenna has been constructed and/or maintained in violation of this chapter, he may, after a ten-day notice to remove said violation, file a complaint in Municipal Court for violation of this chapter. Upon the finding of the Court that the antenna has been maintained in violation of this chapter, the offense shall be punishable by a fine of not more than $1,000 or imprisonment for not more than 90 days, or both, at the discretion of the Court imposing same.
