In Highway Commercial Zones, no lot shall be
used and no structure shall be erected, altered or occupied for any
purpose except the following:
A. Retail sales of goods such as foodstuffs, groceries,
liquors and package goods, pharmaceuticals, confectioneries, ice cream
parlors, stationery, books, tobacco, newspapers, clothing, hardware,
furniture, flowers, jewelry, hobbies, crafts and appliances.
B. Services and activities such as banks and fiduciary
institutions; drive-in window banks; barbershops; beauty salons; photographer
studios and photo developing; video rental stores; tailors; shoe repair;
radio and television repair; bars and taverns; restaurants and luncheonettes,
other than drive-ins; business offices and professional offices; government
buildings; dry cleaners and laundromats; and printing and publishing.
C. Professional and nonprofit organizations and fraternal
lodges.
D. Parking lots and public parking garages, provided
that there are no sales or service.
E. Theaters, bowling alleys, fitness center/exercise
facilities and other forms of commercial recreation, provided that
they are carried on entirely within an enclosed building.
F. Private schools conducted for profit.
G. Telephone offices and low-volume mailing services.
H. Mortuary or funeral homes.
I. Bus passenger stations and taxi stands.
J. Municipal and other governmental buildings and uses.
K. Electric, telephone and public utility installations.
M. Service station, automotive.
N. Houses of worship, as a conditional use. See §
100-117.1 for requirements.
Q. Continuing care facility, conditional use: See §
100-117.1.
The following accessory uses shall be permitted
in the Highway Commercial Zone:
A. Private garage space for the storage of commercial
vehicles.
B. Off-street parking space for the use of patrons and
employees.
C. Signs which relate to the business being conducted, provided that they meet the requirements of §
100-127.
D. Other customary accessory uses which are incidental
to the operation of the business use, subject to the approval of the
Planning Board.
E. A preexisting dwelling unit on the second floor (or
third floor) of an existing business.
The following required conditions shall be complied
with in the Highway Commercial Zone:
A. Principal buildings.
(1) Minimum lot size: 14,520 square feet.
(2) Minimum frontage: 100 feet.
(3) Minimum front setback: 25 feet from the right-of-way.
(4) Minimum side setback: 10 feet; fifty-foot buffer if
adjacent to a residential zone.
(5) Minimum rear setback: 20 feet; fifty-foot buffer if
adjacent to a residential zone.
(6) Maximum percentage of impervious surface area: 30%.
(7) Building height: the lesser of 21/2 stories or 35
feet.
B. Accessory building.
(1) Minimum side yard: 10 feet; fifty-foot buffer if adjacent
to a residential zone.
(2) Minimum rear yard: 20 feet; fifty-foot buffer if adjacent
to a residential zone.
In no event shall the following uses be permitted:
B. Advertising signs and billboards.
E. Massage parlors and sexually oriented businesses.
