In addition to the collection of trash on public
streets accepted or dedicated for public use by the municipality,
trash shall be collected on streets other than streets accepted by
the Township of Evesham in accordance with a uniform schedule of trash
collection established by the Township Manager, provided that all
the following criteria for the provision of said collection service
shall be met:
A. The owner of the roadway shall request in writing
the aforesaid trash collection service.
B. The owner of the roadway shall execute a written agreement
satisfactory to the Township Manager both as to form and content,
which agreement shall hold the Township of Evesham harmless regarding
any damage done by the Township's collection vehicles to roadways.
C. A determination is required by the Township Manager
that the physical circumstances of the subject street permit:
(1) Proper storage of trash so as to avoid the creation
of a public health nuisance.
(2) Ease and efficiency of collection using existing types
of Township equipment.
(3) The safe maneuvering of equipment in the collection
process.
D. The recipients of the said service shall comply with
all conditions of service established by the Township Manager. Examples
of conditions of service shall include but not be limited to:
(1) Physical location of trash containers at time of collection.
(2) Type of trash containers consistent with containers
required throughout the community. However, at the discretion of and
subject to the prior approval of the Township, dumpster containers
may be utilized in certain areas.

E. A determination is required by the Township Manager
that there exists a sufficient volume of public vehicular travel upon
the subject street to warrant the expenditures created by the trash
collection. Said determination shall not affect or require the provision
of other types of services on the subject street.
The terms of this article shall supersede whatever
contrary provisions exist in any approval granted by the Evesham Township
Planning Board or Evesham Township Zoning Board of Adjustment.

Trash placed for collection on both accepted
and nonaccepted streets may not be placed for collection more than
24 hours before the scheduled collection time and must be placed in
a type of container approved by the Township Manager. All containers
must be removed from curbside within 24 hours of the scheduled collection
time.

The owner of any new residential construction shall be responsible
for paying for the cost that the municipality incurs for providing
trash containers to a residential unit prior to the issuance of a
certificate of occupancy for the new home.
