The provisions of N.J.S.A. 4:19-15.1 et seq. regarding licenses and registration tags, kennels, dog control, disposition of money collected, information to be forwarded to the State Department of Health, seizure and impoundment and interference with authorized persons shall be controlling in the Township of Hainesport.
Any person who shall own, keep or harbor a dog of licensing age shall, in the month of January of each year, apply for and procure from the Township Clerk a license and official metal registration tag for each such dog so owned, kept or harbored and shall place upon each such dog a collar or harness with the registration tag securely fastened thereto.

A. 
The person applying for the license and registration tag shall pay a fee of $13.80 for the license of each dog, the sum $1 for the registration tag; and also the fee of $0.20 which shall be forwarded by the Township to the New Jersey State Treasurer for the NJ Pilot Clinic Fund for each dog; for the annual renewal, the fee for the license and registration tag shall pay a total fee of $15. The said annual license shall expire on the last day of February each year, regardless of when the license was obtained. There shall be a late-fee penalty of $15 for a dog who is unlicensed past the last day of February each year. With respect to each dog of reproductive age which has not been neutered or sterilized, there shall be an additional surcharge of $3, which shall be forwarded by the Township to the New Jersey State Treasurer for deposit in the Animal Population Control Fund.

B. 
Dogs used as guides for blind persons and commonly known as "Seeing Eye" dogs, dogs used to assist deaf persons and commonly known as "hearing ear" dogs and dogs used to assist handicapped persons and commonly known as "service" dogs shall be licensed and registered as other dogs hereinabove provided for, except that the owner or keeper of such dog shall not be required to pay any fee therefor.

No person shall keep, harbor or maintain any dog which habitually barks or cries.
No person owning, keeping or harboring any dog shall permit it upon a public highway or outside of the premises occupied by said owner unless such dog is securely confined and controlled by an adequate leash not more than six feet long and is accompanied by a responsible person over the age of 12 years.

A. 
No person owning, keeping or harboring a dog shall permit or suffer it to do any injury or to do any damage to any lawn, shrubbery, flowers, grounds or property. Any person owning, harboring, keeping or in charge of any dog who shall cause, suffer, allow or permit such dog to soil, defile or defecate on any common thoroughfare, sidewalk, passageway, bypass, play area, park or any place where people congregate or walk or upon any public property whatsoever; or upon any private property without the permission of the owner of said property; or within 50 feet of a stream, creek, pond, lake or other body of water shall be subject to a fine of not less than $35 nor more than $100. A person violating this section of this article for a second or subsequent time shall be subject to a fine of not less than $100 nor more than $250. In addition, for a first or any subsequent offense, an offending person may be required by the court to provide restitution for the damage done by the dog, if any, upon the presentation of evidence showing damage to the property. This subsection shall not apply to a blind person using a guide dog.
B. 
The restriction in this section shall not apply to that portion of the street lying between the curblines which may be used to curb a dog under the following conditions:
(1) 
The person who so curbs such dog shall immediately remove all feces deposited by such dog in a sanitary manner.
(2) 
The feces removed from the aforementioned designated area shall be disposed of by the person owning, harboring, keeping or in charge of any dog curbed in accordance with the provisions of this section in a sanitary manner by shovel, container, disposal bag or other such sanitary means.[1]

Except as otherwise provided in this article, upon the entry of a plea of guilty to a first or second offense for a violation of any provisions of this article, the fine shall be $35 for each such offense, and no court appearance shall be required. Upon the issuance of a citation or summons for a third or subsequent offense, a court appearance shall be required. Except as otherwise provided in N.J.S.A. 4:19-1 et seq., and except as otherwise provided in this section, a violation of any provision of this article shall be punishable by a penalty as established in § 1-1 of the Township Code.

This article shall be enforced by Hainesport Township Code Enforcement Officer unless another official is so stated.
