Notwithstanding the issuance of any building permit,
no owner of land shall allow any land disturbance on land owned by
him, and no person or legal entity shall engage in land disturbance,
unless such owner, person or legal entity shall have first constructed
or caused to be constructed and shall maintain so that surface materials,
including but not limited to soil, snow and ice, will not be transported
onto the road a driveway between the road and any structure to be
erected or between the road and the area to be affected by land disturbance.
The driveway shall be used for the purpose of ingress and egress to
the area of land disturbance.
Prior to construction of a driveway, an application for a grading permit shall be made to the Township Engineer as required by Article I of this chapter.
A driveway shall be constructed in accordance with the specifications for private roads serving four or fewer lots set forth in § 225-76B(1) of this Code. Nothing herein contained shall relieve the responsible party from otherwise complying with the construction and design specifications of driveway improvements during the normal course of construction and as required by Article I of this article.
Any gates, pillars and/or posts constructed adjacent to driveways shall be done so in accordance with the requirements set forth in § 225-116Q of this Code. In that regard, notwithstanding the provision of Subsection D of this section, the provisions of § 225-116Q shall be enforced by the Township Zoning Officer, and to the extent it may be required by the Zoning Officer, with the assistance of the Township Engineer.
This chapter shall be enforced by the Township Engineer, and appeals from his determinations hereunder may be taken to the Board of Adjustment after the payment of a fee as set forth in Chapter 171, Fees.
